It was stressed, however, that efforts to minimize equipment and sediments in the water should be made to the greatest extent possible. To review, the original General Permit (GP) #75691A was issued through the emergency permitting phase through 07H.2500 as a result of hurricane damage. Permits issued through 07H.2500 are only permissible after the Department Secretary activates the emergency permit, and the approval process is for rebuilding water dependent structures in the pre-existing footprint, with a specific deadline, which was 09/17/2020. Due to the fact that your new bridge will be wider, and the footprint has changed, it will be required for you to obtain a new GP under 07H.2300. This rule (copy attached) will require that you notify the riparian property owners (Warnell, Thompson and Frisco Woods Campground) of your project. The notification (form attached) can be sent certified mail, return receipt requested (which requires that the USPS get a signed green card as proof of receipt), hand delivered for signature, or sent via email. If you choose to email the documents to the riparian property owners, be sure that they understand you will need a signed copy of the notification back from them for proof of notification. The attached form has an area where you can describe your project. It is important that they receive a copy of your plans as well. I'm also attaching copies of an aerial showing your existing bridge and a snipit.png that may assist you in putting together a drawing showing the proposal. Mr. Welles' email today has confirmed that the bridge is a clear span, and there will be no work in the water for the replacement bridge. However, he has noted that the new bridge is a foot wider (14' versus existing 13'), and therefore I believe we will need to move forward with a General Permit request through 07H.2300. I will forward to each of you a copy of his plans as soon as received so that you can review for a determination of whether a construction moratorium would be applicable. The new bridge beams are not quite as curved as the existing bridge but we will set the beams so that the clearance is the same. The new bridge is a foot wider than the existing bridge but that has no effect on the waterway. I'm guessing "horizontal navigational clearance" means from one side of the canal to the other which will be better with the current intermediate pilings removed. I will track down an electronic copy of the plans or drop a hard copy in mail shortly. I know you need an answer about schedule . I'm trying to tack that down. The bridge parts are complete and are at the galvanizing plant. Should be done next week and ready for installation. The GP that was issued back in January noted that the existing bridge was 49'x13' (length x width). We didn't note the existing elevation/height of the existing bridge: however, it does state in 07H.2305(c) that replacement of existing bridges shall not reduce vertical or horizontal navigational clearances. The scan that you sent me is a bit fuzzy (i.e. hard to read the measurements). The Elevation View numbers look like 2'- 4,1/8 and 2'-0, 1/8? Is this the elevation from where the bridge will start on land? Is there any way your engineer could send a better copy showing the page in its entirety? It looks like it was perhaps drawn by King George(?) ... google search shows that number matches up to a King George Welding, Inc in King George, VA. The GP was issued on January 8, 2020 under the rule of 07H.2500 for the replacement of the vehicular bridge damaged by Hurricane Dorian, with an expiration of 09/17/2020. Before the Director can make a determination as to whether your project qualifies for an extension of the expiration date, we would need more detailed information that relates to the delay in starting your project-> How has the pandemic (Covid-19) affected your ability to start/finish the project on time, such as: • How were you affected physically, • Were there issues with the availability of materials, • Availability (timeline) in regard to obtaining a contractor, • Availability (timeline) in regard to obtaining an engineer, and • No work has started; we would need an estimated start and completion date. One other piece of information that the Director will need is whether the Division of Marine Fisheries (DMF) would require a Moratorium in your project area. I have contacted the representatives for DMF and the NC Wildlife Resources Commission (WRC) for further verification. The reason I have included the WRC representative is that, if the extension was not granted, a new GP would be required through our rule of 07H.2300 (Replacement of Existing Bridges and Culverts... copy of rule is attached). General condition 7H.2304(h) requires that the review of individual project requests be coordinated with the DMF and WRC. This may result in a construction moratorium during periods of significant biological productivity or critical life stages as determined by the WRC and DMF. The WRC representative has requested further information, as she notes, understanding the project's design and impacts would help us determine if a moratorium is appropriate, and wanted to know of any bents or activities proposed in the water. I did share with her the site photos and footprint of your current bridge. Would it be possible to obtain a pdf scan of your current design, work plan drawings/cross-sectional drawings, for your replacement pier to share with Division staff, DMF and WRC? In review of Google Earth, it 'may' have originated in the early -mid 90's. Frank and Joan Welles purchased the property from James Grieves and Stuart Egerton back in 1988. The private bridge/driveway was the only legal access to the Welles' property; however, he has temporary permission to go through the Frisco Woods Campground to enter his property through an impermanent opening on the northern side of his parcel. The emergency GP was issued for the replacement in the pre-existing footprint, dimensions of 49'x13. It did span the entire waterbody, and pilings were in place on each end (see site photos attached). Mr. Welles has noted that it took a while to get a contractor to come onsite, to get the design stamped by an engineer and then fabrication of the material. The steel has been taken to a galvanizing facility. The emergency permit expedited the approval process for rebuilding water dependent structures. In January 2020, General Permit 75691 was issued to Frank and Joan Welles to rebuild their vehicular bridge in the existing footprint at 53225 Lands End Way in Frisco, Dare County, which crosses a canal. The emergency permit expired on 09/17/2020, and the Welles have not been able to start construction of the replacement bridge for various reasons. Division staff will need to make a determination on whether the property owners qualify for an extension of their permit, or if they will be required to apply for a new permit through 7H.2300 (General Permit for Replacement of Existing Bridges and Culverts in Estuarine Waters, Estuarine and Public Trust Shorelines, Public Trust Areas and Coastal Wetlands) Before an extension request could be granted, one piece of information that the Division would need to verify is that there is no DMF moratorium.
