We received the ADJACENT RIPRIAN PROPERTY OWNER FORM March 2, 2004. Specifically, we OBJECT TO THE ROOF over the 12' X 16' platform. We do not object to the pier,only the roof over the platform. The roof will seriously block our southward view of the marsh, the beautiful sunsets, and boat traffic in Motts Channel. It will also block the southward view of 7 additional lots located to the North. In the NC State Code for pier permits section 15NCACO7H.1204,para. D, it states, "This permit will not be applicable to proposed construction where the Department believes that the proposed activity might unnecessarily endanger adjoining properties; significantly affect historic, cultural,scenic, conservation or recreation values, etc."Scenic views are included in values as a part of property evaluations. The roof over this platform will decrease the enjoyment of our view and the value of our property. [ inquired at your Wilmington Coastal Management office about the process for objecting to an application. I was told that if we objected to an application the local office would give the permit any way as long as the proposed construction met the rules, and the objection would be sent to Raleigh. NC Code 15ANCACO7H.1202 sect. bl requires the applicant provide a written statement from the adjacent riparian owner indicating they have no objection. It sounds as if an objection is a formality with no meaning. By this letter we request a permit not be granted for this project on the grounds it will decrease the enjoyment of our property and it will decrease the value of our property. The roof on this pier will greatly affect our scenic view. Real estate appraisers include value for views when appraising property. Real estate companies advertise views as selling points for property. Any encroachment on views lowers property values and decreases the enjoyment of the property. Apparently, the Division of Coastal Management does not value scenic views. Let us be very clear. We do not oppose the pier. We do oppose the roof over it. Your regulations require the applicant get signatures from the adjoining property owners. We did not sign that we agreed with the original application, in fact, we sent a letter to you stating our objection to the application. In spite of the objection, your office immediately gave the applicant a permit. This appears to me a miscarriage of justice, an after the fact appeal, since the applicant could be finished with the pier by the time an appeal is filed. We received the ADJACENT RIPRIAN PROPERTY OWNER FORM March 2, 2004. Specifically, we OBJECT TO THE ROOF over the 12' X 16' platform. We do not object to the pier, only the roof over the platform. The roof will seriously block our southward view of the marsh, the beautiful sunsets, and boat traffic in Motts Channel. It will also block the southward view 7 additional lots located to the North. In the NC State Code for pier permits section 15NCAC07H.1204, para. D, it states, "This permit will not be applicable to proposed construction where the Department believes that the proposed activity might unnecessarily endanger adjoining properties; significantly affect historic, cultural, scenic, conservation or recreation values, etc." Scenic views are included in values as a part of property evaluations. The roof over this platform will decrease the enjoyment of our view and the value of our property. I inquired at your Wilmington Coastal Management office about the process for objecting to an application. I was told that if we objected to an application the local office would give the permit any way as long as the proposed construction met the rules, and the objection would be sent to Raleigh. NI Code 15ANCAC07H.1202 sect. bl requires the applicant provide a written statement from the adjacent riparian owner indicating they have no objection. It sounds as if an objection is a formality with no meaning. The roof on this pier will greatly affect our scenic view. Real estate appraisers include value for views when appraising property. Real estate companies advertise views as selling points for property. Any encroachment on views lowers property values and decreases the enjoyment of the property. Apparently, the Division of Coastal Management does not value scenic views. Let us be very clear. We do not oppose the pier. We do oppose the roof over it. Your regulations require the applicant get signatures from the adjoining property owners. We did not sign that we agreed with the original application, in fact, we sent a letter to you stating our objection to the application. In spite of the objection, your office immediately gave the applicant a permit. This appears to me a miscarriage of justice, an after the fact appeal, since the applicant could be finished with the pier by the time an appeal is filed.
