The constructing of the fixed pier has been determined to comply with the Rules of stal Resources Commission(7H.1200)- General Permit for construction of piers, docks, and boat house ?stuarine Shoreline AEC, and as such,a permit has been issued to authorize the development. I have osed a copy of the permit,as well as,the relevant statutes. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Heal request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The ing request must be filed with the Director, Division of Coastal Management, in writing and must be ived within twenty(20) days after the disputed permit decision is made. Sincerely, Jim Gregson District Manager Description of the Dock Project 10\- At 1637 Sound Watch Drive / Proposed New Pier This mailing to you is to fulfill the CAMA requirement that the owners of lots next to a dock project need to be notified prior to the beginning of dock construction. Your property is adjacent to my home at 1637 Sound Watch Drive. Enclosed are the drawings to scale of the dock project that I am planning on building in my riparian corridor in front of my home. Please notice that: • all parts of the dock will be at least 15 feet from the riparian setback, • the south side of my dock will be about 42 feet from the north edge of the boatlifts in the existing IntraCoastal Watch Community Dock, • the dock length was made much shorter than the IntraCoastal Watch Community Dock, so as not to interfere with the boats coming in and out on the north side of that dock, • the end of the dock will have a boat lift on the north side of the dock. • there will be a 12 foot by 12 foot gazebo on the north side of the dock. I will be hiring a surveyor to insure that the dock stays at least 15 feet from the property lines as it extends into the water, which will include all dock structures such as the gazebo and boat lift. Your property is adjacent to my home at 1637 Sound Watch Drive. This project was previously approved by CAMA last year. Because the time period for the previous permit for this project ran out, I need to re-apply for the same permit again. The first 96 feet of the dock from the driveway to the beginning of the marsh grass will be moved over to a point that is exactly centered between 1636 and 1637, so that there will be 12 feet between the two houses from the north and south edges of the dock walkway. (This will mean that there will still be 2 feet on the south side of the dock walkway to 1637 Sound Watch Drive property line.) Once the walkway reaches the existing marsh grass line, the rest of the dock--up to where the existing dock angles out to the gazebo--will be moved to reconnect the first 96 feet to that"over water"portion in a straight line. As you can see on the map, the dock will come out 330 feet, 70 feet shorter than the existing dock owned by the Sound Watch Home Owners Association (HOA). This shorter length will insure that there is more than adequate space for boats entering the slips in the HOA dock. I am writing to follow up on our recent discussions about CAMA General Permit No.43928 issued by DCM to Arthur J. Frankel at 1637 Sound Watch Drive in Wilmington. The permit, which was issued on January 20, 2006, authorizes construction of a pier adjacent to Dr. Frankel's lot, which is located in the Intracoastal Watch Subdivision located on Everett's Creek in Myrtle Grove Sound near the Atlantic Intracoastal Waterway. Currently, there is a 10-slip community pier for use by the residents of Intracoastal Watch located within a 20-foot wide private access easement across Dr.Frankel's property. New Hanover County required a Special Use Permit (SUP) for the construction of the community pier. The community pier was further authorized under CAMA Major Permit No. 105-98 issued on July 31, 1998, to Daclar, Inc., c/o Teresa Robinson. Ms. Robinson was the original developer of the Intracoastal Watch subdivision. A question has arisen as to whether it is inconsistent with the SUP issued to the developer for Dr.Frankel to now have his own pier originating from his waterfront property. Petitioners Frank and Sandra Teti are the owners of an undeveloned lot immediately north of Dr.Frankel's lot. They r Page 2 Letter to A. If the County determines that the development is inconsistent with the SUP, my client will acknowledge that the permit should not have been issued. An evidentiary hearing in the case was recently continued in order for the parties to obtain a decision on this matter. We understand that your office has not yet made a decision on the consistency issue because Dr.Frankel has not formally applied for a building permit that would trigger such review. However,my client requests that you provide us with a decision so that we can potentially avoid unnecessary and costly litigation.
