A permit under this Section shall allow for the installation of utility lines both aerially and subaqueously in the coq

15A NCAC 07H.1602 APPROVAL PROCEDURES
(a) The applicant must contact the Division of Coastal Management and complete an application form requesting approva.

(b) The applicant must provide:
(1) confirmation that a written statement has been obtained signed by the adjacent riparian property own
indicating that they have no objections to the proposed work;or

work. Such notice should instruct adjacent property owners to provide any comments on the propo
development in writing for consideration by permitting officials to the Division of Coastal Managem
within ten days of receipt of the notice,and,indicate that no response will be interpreted as no objecti
DCM staff will review all comments and determine,based on their relevance to the potential impacts of
proposed project,if the proposed project can be approved by a General Permit. If DCM staff finds that
comments are worthy of more in-depth review, the applicant will be notified that he must submit
application for a major development permit.
(c) No work shall begin until an on-site meeting is held with the applicant and appropriate Division of Coastal Managem
representative so that the utility line alignment can be appropriately marked. Written authorization to proceed with
proposed development will be issued during this visit. Construction on the utility line must begin within twelve months of t
visit or the general authorization expires.

15A NCAC 07H.1604 GENERAL CONDITIONS
(a) Utility lines for the purpose of this general permit or any pipes or pipelines for the transportation of potable watc

(e) Individuals shall allow authorized representatives of the Department of Environment,Health,and Natural Resources
make periodic inspections at any time necessary to ensure that the activity being performed under authority of this gene
permit is in accordance with the terms and conditions prescribed herein.
(f) This general permit will not be applicable to proposed construction where the Department has determined,based on
initial review of the application,that notice and review pursuant to G.S. 113A-119 is necessary because there are unresolv
questions concerning the proposed activity=s impact on adjoining properties or on water quality;air quality;coastal wetlan
cultural or historic sites;wildlife; fisheries resources; or public trust rights.
(g) This permit does not eliminate the need to obtain any other required state,local,or federal authorization,nor,to abide
regulations adopted by any federal or other state agency.
(h) Development carried out under this permit must be consistent with all local requirements,AEC guidelines,and local La
Use Plans current at the time of authorization.

15A NCAC 07H.1605 SPECIFIC CONDITIONS
Proposed utility line installations must meet each of the following specific conditions to be eligible for authorization by th
general permit:
(1) All domestic sanitary sewer line requests must be accompanied by a statement of prior approval from tl
NC Division Water Quality.
(2) All spoils which are permanently removed must be placed on a high ground disposal site and stabilized s
as not to return to waters,marsh or other wetlands.
(3) Any additional backfill material required must be clean sand or rock free of organic matter.
(4) Cuts through wetlands must be minimized.
(5) Finished grades or subaqueous or wetland crossing must be returned to preproject contours.
(6) There can be no work within any productive shellfish beds.
(7) No excavation or filling activities will be permitted between April 1 and September 30 of any year withi
any designated primary nursery area.
(8) Subaqueous lines must be placed at a depth of six feet below the project depth of federal projects. In othe
areas they will be installed at a minimum depth of two feet below the bottom contour.
(9) The minimum clearance for aerial communication lines or any lines not transmitting electricity will be 1(
above the clearance required for bridges in the vicinity.
(10) The minimum clearance for aerial electrical transmission lines shall be consistent with those established b:
the US Army Corps of Engineers and US Coast Guard.
(11) The installation of a utility line on pipe bents or otherwise above the elevation of mean high or meat
ordinary water must be of sufficient height to allow for traditional navigation in the water body
Additionally the utility line must not interfere with the waterflow of normal or flood waters.
(12) Natural gas lines must not exceed 11 inches in diameter.

In accordance with your letter dated April 29, 2004, please accept this letter and the attached check for
$18,000 to address the payment requirements associated with the wetland impacts and the West Brunswick Regional
Wastewater System.
The U.S. Army Corps of Engineers, the Division of Coastal Management and the Division of Water
Quality(401 Unit)have all been made aware of our desire to make payment to the NCWRP for mitigation purposes
and all have responded favorably to this approach.
The fee amount of$18,000 was determined based upon 0.36 acres of permanent wetland impacts and a 2:1
mitigation replacement ratio. The resulting mitigation was rounded up to the nearest 0.25 acre and multiplied by
$24,000(0.36 x 2 =0.72 rounded up to 0.75 x$24,000=$18,000).

On behalf of Brunswick County, I am requesting payment into the NC Ecosystem Enhancement Program
(EEP) in-lieu fee program in order to provide suitable compensatory wetland mitigation for proposed impacts to
jurisdictional wetlands associated with permanent fill for access roads and pump stations. The proposed
project will result in the impact of 0.36 acres riparian and nonriparian wetlands within the Lumber River Basin,
Cataloging Unit#03040207 near Supply (NC) (refer to enclosed maps).
Please notify me as to whether the EEP will accept payment into the program for the proposed impacts. The
Corps of Engineers (COE), has requested a 2:1 replacement ratio for proposed impacts. It is our
understanding that any payment made will be based upon 0.25-acre increments. Therefore,the applicant is

Property: The Brunswick County Engineering Department will construct a wastewater collection system
and associated infrastructure on county-owned land and within NCDOT rights-of-way along regional
roadways. The NCDOT right-of-way work associated with this permit verification will be conducted
mainly along US Hwy 17,US Hwy 17 (Bus.),NC Hwy 130, and State Roads 211, 1115, 1130, and 1140.
See the attached vicinity map for diagram of the area of operations(attachment 2).
Description of Activity: The authorized project consists of installation of force mains and permanent
wetland fill at three road crossings. The force main work consists of temporary trenching and backfilling
through Or under waters of the U.S. consisting of intermittent and perennial streams and ditches, and
jurisdictional wetlands.The pernuttee will dig and backfill approximately 7,636 linear feet of trenches
for the installation of force mains. Some force main installation will involve directional drilling,which
will not itnpact waters of the U.S. The three road fills involve permanent wetland loss totaling 0.36 acres.
The locatlion and scope of the permanent wetland fills are shown in attachment 4.The linear force main
crossings are listed in the attached tables (attachment 3).Locations of the individual force main
crossings,wetland fill cross-sections, and the wetland delineations for this project are in file folder No.
200400411.Those diagrams are included in this verification by reference. The referenced work shall be
performed in accordance with the specifications and conditions outlined in Nationwide Permit 12(see
attachment 1). Mitigation is required for the permanent wetland fills(see special condition 1).
Your work is authorized by this Nationwide Permit(NWP)provided it is accomplished in accordance with
the attached plans and the permit's general,regional,and special conditions.

This verification will remain valid until June 1, 2006 unless the nationwide authorization is modified,
reissued or revoked. If, prior to June 1, 2006, the nationwide permit authorization is reissued and/or
modified,: this verification will remain valid until June 1, 2006, provided it complies with all
modifications. If the nationwide permit authorization expires or is suspended, revoked, or is modified,
such that the activity would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., arc under construction) or are under contract to commence in
reliance upon the nationwide permit, will remain authorized provided the activity is completed within 12
months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary

Special Condition
1. In-lieu fee mitigation. To offset the adverse environmental impacts from the authorized project,the
permittee shall pay to the North Carolina Ecosystem Enhancement Program(NC EEP)the amount NC
F.F.P determines is sufficient to restore 0.72 acres of wetland habitat in the Lower Cape Fear River Basin
(Hydroldgic Unit 03030005) Cataloging Unit.The authorized project shall not begin until the permittee
has made full payment to the NC EEP and has provided a copy of the receipt to the Corps of Engineers,
Wilmington Regulatory Office and until the NC EEP has provided written confirmation to the Corps that
it agrees to accept responsibility for the required mitigation work. This requirement ensures compliance
with the Memorandum of understanding between the North Carolina Department of Environment and
Natural Resources and the United States Army Corps of Engineers,Wilmington District,dated
November 4, 1998.

Dear Jim:
On behalf of Brunswick County, I am submitting a request for authorization under a CAMA General Permit
for utility line installation associated with the West Brunswick Regional Wastewater Treatment System. As
discussed in our meeting on February 27th(2004), the applicant proposes to install sewer lines(via
horizontal directional drill)under four areas identified either as navigable waters or coastal marsh. These
areas are depicted on the enclosed maps and project design drawings. In addition, a spreadsheet of all
proposed temporary and permanent impacts associated with the project is enclosed (see sheets 1 &2).
Those areas identified as navigable waters or coastal marsh are highlighted on the attached spreadsheet.
The following information is being provided to your office for your use in reviewing the request for
authorization:
(1) Check in the amount of$100 made payable to DENR;
(2) Agent authorization form;
(3) Project narrative;

PROJECT NARRATIVE
Brunswick County is proposing to construct a regional wastewater treatment system that
includes a sewer collection system, a dedicated drip irrigation site, and a wastewater
treatment facility site. An Environmental Assessment was prepared for this project and a
FONSI was subsequently issued by NC DWQ. In addition, the USACE has provided
recent confirmation that the Section 404 permit will be processed under a NWP 12. In
addition, the 401 Water Quality Certification was recently issued by the NC DWQ.
Of the over 2,000 acres and 26 miles of NCDOT right-of way contained within the
project area, a total of 0.36 acres of permanent wetland impacts are being proposed. The
applicant's design engineers have worked extensively to avoid and minimize disturbance
to jurisdictional wetlands/waters on each of the three major project areas. Project
infrastructure(including pump stations, treatment ponds, access roads, etc.) have avoided
all jurisdictional areas with the exception of three maintenance access roads.
Project design includes horizontal directional drilling under all navigable waters and/or
coastal marsh(see enclosed Sheets 1 and 2). Specifically, there are four locations where
this is to occur: (1) Shallotte Creek and Oxpen Rd. (see URS sheet D38); (2)

located adjacent to the proposed project area for the above-referenced project These notifications were
sent on May 5th (2004). In addition, I have enclosed one of the notification/waiver forms that had been
returned to our office.
