The applicant shall provide information on site location, dimensions of the project area, and his name address. (b) The applicant must provide: (1) confirmation that a written statement has been obtained signed by the adjacent riparian property own indicating that they have no objections to the proposed work;or (2) confirmation that the adjacent riparian property owners have been notified by certified mail of the propo work. Such notice should instruct adjacent property owners to provide any comments on the propo development in writing for consideration by permitting officials to the Division of Coastal Managem within ten days of receipt of the notice,and,indicate that no response will be interpreted as no objecti DCM staff will review all comments and determine,based on their relevance to the potential impacts of proposed project,if the proposed project can be approved by a General Permit. If DCM staff finds that comments are worthy of more in-depth review, the applicant will be notified that he must submit application for a major development permit. (2) All spoils which are permanently removed must be placed on a high ground disposal site and stabilized s as not to return to waters,marsh or other wetlands. (3) Any additional backfill material required must be clean sand or rock free of organic matter. (4) Cuts through wetlands must be minimized. (5) Finished grades or subaqueous or wetland crossing must be returned to preproject contours. (6) There can be no work within any productive shellfish beds. (7) No excavation or filling activities will be permitted between April 1 and September 30 of any year withi any designated primary nursery area. (8) Subaqueous lines must be placed at a depth of six feet below the project depth of federal projects. In othe areas they will be installed at a minimum depth of two feet below the bottom contour. (9) The minimum clearance for aerial communication lines or any lines not transmitting electricity will be 1( above the clearance required for bridges in the vicinity. (10) The minimum clearance for aerial electrical transmission lines shall be consistent with those established b: the US Army Corps of Engineers and US Coast Guard. (11) The installation of a utility line on pipe bents or otherwise above the elevation of mean high or meat ordinary water must be of sufficient height to allow for traditional navigation in the water body Additionally the utility line must not interfere with the waterflow of normal or flood waters. The U.S. Army Corps of Engineers, the Division of Coastal Management and the Division of Water Quality(401 Unit)have all been made aware of our desire to make payment to the NCWRP for mitigation purposes and all have responded favorably to this approach. The fee amount of$18,000 was determined based upon 0.36 acres of permanent wetland impacts and a 2:1 mitigation replacement ratio. The resulting mitigation was rounded up to the nearest 0.25 acre and multiplied by $24,000(0.36 x 2 =0.72 rounded up to 0.75 x$24,000=$18,000). The force main work consists of temporary trenching and backfilling through Or under waters of the U.S. consisting of intermittent and perennial streams and ditches, and jurisdictional wetlands.The pernuttee will dig and backfill approximately 7,636 linear feet of trenches for the installation of force mains. Some force main installation will involve directional drilling,which will not itnpact waters of the U.S. The three road fills involve permanent wetland loss totaling 0.36 acres. The locatlion and scope of the permanent wetland fills are shown in attachment 4.The linear force main crossings are listed in the attached tables (attachment 3).Locations of the individual force main crossings,wetland fill cross-sections, and the wetland delineations for this project are in file folder No. 200400411.Those diagrams are included in this verification by reference. The referenced work shall be performed in accordance with the specifications and conditions outlined in Nationwide Permit 12(see attachment 1). In addition, the USACE has provided recent confirmation that the Section 404 permit will be processed under a NWP 12. In addition, the 401 Water Quality Certification was recently issued by the NC DWQ. Of the over 2,000 acres and 26 miles of NCDOT right-of way contained within the project area, a total of 0.36 acres of permanent wetland impacts are being proposed. The applicant's design engineers have worked extensively to avoid and minimize disturbance to jurisdictional wetlands/waters on each of the three major project areas. Project infrastructure(including pump stations, treatment ponds, access roads, etc.) have avoided all jurisdictional areas with the exception of three maintenance access roads.
