The Third Party Hearing Request was filed on behalf of petitioner Ms. N. Kay Crocker on May 12, 2005. Under N.C.G.S. §113A-121.1 (the Coastal Area Management Act), your CAMA permit is automatically suspended upon receipt of a hearing request and will remain suspended until either: (1) Chairman Hackney denies the hearing request (under standards set out in the statute); or (2)there is a final Coastal Resources Commission decision on the permit appeal. You may not undertake any development under the permit until further notice after Chairman Hackney issues his decision. The Division of Coastal Management will prepare a recommendation for the Chairman on whether to grant or deny the hearing request. The Chairman must make a decision within 15 days after receipt of the hearing request. If you wish to submit any materials for the Chairman's consideration in ruling on the request for contested case hearing, please send them to me as soon as possible. Our objections are as follows: 1. There is no registered survey describing meets and bounds of all properties and showing encroachment of existing facilities. 2. There is no management plan for materials to be removed and disposed from areas of encroachment on both properties. 3. We would like for said owner to show full proof that this work meets all federal, state, and city guidelines, land use plans, and regulations before permit is issued by CAMA. 4. We would like certified documentation the application being brought forth is from the legal owners of said properties. This clarification of ownership ensures that the legal owners are responsible for all actions during this entire process. The first step in the project is to have everything resurveyed before any work to install or remove the bulkhead has begun. Using an excavator, we will dig out behind the existing north and south wall where the new proposed bulkhead will be installed. After the new bulkhead is completed, the old remaining bulkhead(in front) will be removed and hauled off. Due to the current condition of the existing wall, it is possible that some brick, block and/or debris may be knocked over onto adjacent beaches either during excavation, construction or removal. If this should occur, any such materials will be removed by excavator,hand or both; and be placed onto high ground. The void area created between the new bulkhead and the neighbor's existing concrete bulkheads will be repaired(filled with concrete)to prevent any seepage. The western bulkhead will be placed approximately(2) feet in front of the existing concrete bulkhead. When complete, everything will be back-filled and a ground cover installed.
