We feel that NO additional fill, dirt or other material should or needs to be placed on #3 Banks Road either now or in the future. The previous unauthorized landscaping has led to an unfair disparity in property levels and the situation should not be made worse in any way, shape or form. As I explained to you this morning the three owners at 4 Banks Road have been concerned that Mr. Winston would not abide by the rules and regulations for landscaping lots. This concern has been based on his actions the past 8 months and the erosion problem that has developed along our bulkhead. I was encouraged that you felt Mr. Winston had finally gotten the message that he had to operate within the regulations that are established for all property owners. Based on your recommendation of his proposed landscaping improvements and the assurance that no more fill dirt will be dropped on 3 Banks Road we will not object to the project as presently proposed. We understand that three to four additional loads of dirt will be used to build the berm but that is the extent of any additional dirt being placed on this lot. Due to approximately 35 truckloads of fill dirt that have been placed on this lot without any CAMA permit, our lot is noticeable lower and we may continue to have erosion problems due to drainage from the Winston property. We are hopeful that the proposed landscaping will correct this problem and prevent future erosion on our property. We appreciate your assistance with this problem. I was pleased to hear you say that you would watch this project very closely. I am sure that all parties involved with the work at 3 Banks Road will obey the regulations and the CAMA permit if they know you are keeping a watchful eye over this project. We are agreeing to this proposal based on the conversation I had with you and your assurance that no more fill dirt would be placed on 3 Banks Road. I understand that you will need to use 3 to 4 more truckloads of dirt to build the berm that you have proposed but that is the extent of any additional dirt being placed on this lot. Due to the 35 truckloads of fill dirt that have been placed on this lot without any CAMA permit, our lot is noticeable lower and we may continue to have erosion problems due to the drainage from the Winston property. We are hopeful that the proposed landscaping will correct this problem and prevent future erosion on our lot and bulkhead. I have spoken with Debra Wilson, CAMA Zoning Enforcement Officer, regarding this permit and she recommended we approve this project. She assured me that she would be watching this work very closely to insure that all parties abide by the regulations authorized by this permit. We have approved their request with the stipulation that no more than 7 truckloads of dirt to be used in building this berm and no additional dirt be dumped on this lot. Also, there will be no grading done. Based on your suggestion I sent a letter to Ann Hines requesting that she monitor this project. All three owners at 4 Banks Rd. are still a little skeptical of the Winstons abiding by the rules and regulations after their blatant disregard for the landscaping rules when they dumped approximately 35 loads of dirt on their lot without a LAMA permit. Due to this additional dirt being added to their lot in late 2000, we had an erosion problem with our backyard and bulkhead in early 2001. I met with Art Poineau and his recommendation was to have the Winstons build a berm to prevent the water from draining on our lot. The berm appears to have corrected this problem but this amount of dirt should not have been placed on this lot and created such a disparity in the height of our two lots. I am enclosing all the correspondence and pictures that pertain to this issue so that you can have them on file. Hopefully, this is the last dirt that will added to 3 Banks Rd. I am one of three owners of the house at 4 Banks Rd. As you will see from the enclosed papers we have approved his request with the stipulations that only 7 truckloads of dirt be used for the berm and no grading be done on the lot. In late 2000, the Winstons had approximately 35 truckloads of dirt dumped on this lot without a CAMA permit. I met with Debra Wilson to have her assist us in making sure no additional dirt be added to 3 Banks Rd. Due to this additional dirt and the disparity it created in the heights of our two lots, we had an erosion problem with our backyard and bulkhead in early 2001. It was necessary to have a berm built to prevent the water from draining on our lot. At that time I wrote Debra requesting that she monitor the project to insure that the Winstons abide by the regulations authorized by this permit. The purpose of this letter is to ask you to have someone monitor the work that will be done on this new berm to insure that any new dirt that is dumped on their lot is used only for the berm. We are opposed to additional any fill dirt or grading on their lot. We appreciate your assistance in this matter. I hope you understand our concern based on how the Winstons have ignored the CAMA regulations and raised the height of their lot without any approval from the authorized parties.
