SECTION.1600-GENERAL PERMIT FOR THE INSTALLATION OF AERIAL AND SUBAQUEOUS
UTILITY LINES WITH ATTENDANT STRUCTURES IN COASTAL WETLANDS: ESTUARINE WATERS
PUBLIC TRUST WATERS AND ESTUARINE SHORELINES
15A NCAC 07H.1601 PURPOSE
A permit under this Section shall allow for the installation of utility lines both aerially and subaqueously in the coast
wetland,estuarine water,public trust areas and estuarine and public trust shoreline AECs according to the authority provide
in Subchapter 7J.1100 and according rules in this Section. This general permit shall not apply to the ocean hazard AEC

15A NCAC 07H.1602 APPROVAL PROCEDURES
(a) The applicant must contact the Division of Coastal Management and complete an application form requesting approval f
development. The applicant shall provide information on site location,dimensions of the project area, and his name ar
address.
(b) The applicant must provide:
(1) confirmation that a written statement has been obtained signed by the adjacent riparian property owne
indicating that they have no objections to the proposed work;or
(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the propose
work. Such notice should instruct adjacent property owners to provide any comments on the propose
development in writing for consideration by permitting officials to the Division of Coastal Managemei
within ten days of receipt of the notice,and,indicate that no response will be interpreted as no objectioi
DCM staff will review all comments and determine,based on their relevance to the potential impacts oftl
proposed project,if the proposed project can be approved by a General Permit. If DCM staff finds that tl
comments are worthy of more in-depth review, the applicant will be notified that he must submit a
application for a major development permit.
(c) No work shall begin until an on-site meeting is held with the applicant and appropriate Division of Coastal Managemei
representative so that the utility line alignment can be appropriately marked. Written authorization to proceed with tl
proposed development will be issued during this visit. Construction on the utility line must begin within twelve months of th
visit or the general authorization expires.

Guidelines for Access: The staff of the Wilmington Regional Office is dedicated to making public
records in our custody readily available to the public for review and copying. We also have the
responsibility to the public to safeguard these records and to carry out our day-to-day program obligations.
Please read carefully the following guidelines before signing the form:
1. Please call at least a day in advance to schedule an appointment to review the files.
Appointments will be scheduled between 9:00 a.m. and 3:00 p.m. Viewing time
ends at 5:00 p.m. Anyone arriving without an appointment may view the files to the
extent that time and staff supervision is available.
2. You must specify files you want to review by facility name. The number of files that you
may review at one time will be limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if tim
permits. Copies of 25 or less are free, 26 or more require payment in full for all
copies made at 10 cents a copy_; payment may be made by check, money order, or
cash at the reception desk. Copies can also be invoiced for your convenience.
4. FILES MUST BE KEPT IN THE ORDER YOU FOUND THEM. Files may not be taken
from the office. To remove, alter, deface, mutilate, or destroy material in one of these
files is a misdemeanor for which you can be fined up to $500.00.
5. In accordance with General Statute 25-3-512, a $20.00 processing fee will be charged
and collected for checks on which payment has been refused.
