REGAN SeQetary Coastal Management BRAXTON DAVIS ENVIRONMENTAL QUALITY DL e`.tor BUFFER AUTHORIZATION CERTIFICATE FOR PIER AND DOCKING FACILITIES ACCESS WAY A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico & Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 02B.0233 & .0259. The Division of Coastal Management (DCM), through a Memorandum of Understanding with the Division of Water Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies with the aforementioned regulations. Those activities covered by your Coastal Area Management Act(CAMA) permit have received Buffer Authorization provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to comply with this Buffer Authorization may subject the property owner and the party (contractor) performing the construction and/or land clearing to a civil penalty by DWR of up to $25,000 per day per violation. >. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft. riparian buffer perpendicularly (which is defined as between 75 and 105 degrees) unless otherwise approved by DCM. The alignment shall minimize the removal of woody vegetation to the greatest extent practicable. 2. Pervious Materials: All reasonable measures shall be taken to ensure the access way is made of pervious materials like open-slatted wood or composite, mulch, or grass to meet the intent of the rules to the maximum extent practicable. 3. Access Width:The width of the pier or docking facility access way shall be limited to six (6) feet. 4. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your property indicating the relative location of the pier or docking facility and any requested access way. When you first presented your desire to build a pier for access to your boat and boat lift by "Going Out 80 F and a deck that would be 12 Ft X 10 Ft going to the East", I did not see any issue with your desire. Your logic was that you are currently accessing your boat lift buy using Sam Snow's pier and that he was gc.ing to tear it down and build a new one for a "Boat Lift" and deck with a "Gazebo" at the end approximately 150 �t from the shore. I received a "Certified Letter" dated 09-10-20 and was signed by [Not me or my Daughter Danielle Rees] an (Unknown) "Individual" on 09-12-20 at 11:00 AM. When we talked on Wed 09-16-20 I had quickly reviewed the documents and got your clarification that this proposed pier was not to gain access to your boat and boat lift. That if for some reason in the future you could not access either the existing pier, new pier, or if the ownership of the pier should change that you wanted to have a pier for your boat and boat lift in the future and you wog d have to relocate your existing boat lift. All that makes reasonable sense. Frank &Teresa My concern is with your proposed design is the possible damage to your pier and my boat. There are other boat lifts up and down the river that access their lift from the back in lieu of from the river. There is a Fountain Power Boat just a few houses to the East of us that does the same. We all are "Boaters" and even in the most favorable conditions, docking a boat can present difficulties. You have watched me enter my boat lift at different sea states during daylight and at night conditions. You both have been on my boat when I have entered the Lift. I appeal to you to consider the following options: 1. Reduce the length of your pier 2. See if you and Teresa can get an easement or some legal document to build the pier that I assumed was your intent as listed above and be able to get on your boat & boat Lift in its present location. 3.
