C. 28480 June3, 2005 Dr. Kamran Goudarzi 110 Seapath Estates Wrightsville Beach,NC 28480 Dear Kamran, With respect to the attached CAMA Notification/Waiver Form, I have now left three phone messages requesting that you call me regarding this notice but have not received a return call. The reason for this request was to get some answers to a few basic questions and to also make you aware of the details of the pier construction which is being permitted across the creek behind your home and mine by a developer who is building a group of condos back there with three new piers. The above waiver notice only gave me 10 days to reply so, lacking a return phone call. I am writing this letter as a reply. First of all, as I have told you many times, I very much support your getting a new bulkhead as the present one is failing badly and is leaking sand into the dredged channel at a pretty good clip. Between this problem and the pier head violations on the opposite side of the channel, without your rebuilding the bulkhead,the channel would soon be totally plugged up, so I am very much in favor of going ahead with the project. I am sure all of the other property owners on my end of the creek would also agree with this. However, I do have some questions which I would like answered about the project before a sign off and these are as follows: (1) Approximately when would this construction be done and how badly will the barges block the channel and for what duration? (2) Will the bulkhead be constructed of concrete reinforced sheets with a cap and tie backs in the same way the rest of the Seapath Estates bulkhead is constructed? (3) Will the bulkhead contractor install filter cloth behind the wall so it will not leak sand like your present bulkhead does? ( I do not believe the present bulkhead had filter cloth which is probably one of the major reasons it leaks sand so badly) . ,, ..- ' ' ' ' --„�� vviLMINGTON7 NC • JUN 0 6 2005 substantial amount of sand in the channel, especially in the 20 feet nearest the new bulkhead. The question I have is: How can we make sure that the bulkhead contractor removes this sand from the channel after construction of the bulkhead is finished? I do not even ask you to pay for all this as I certainly would be willing to pay part of the cost. But we should together try to get the channel at least back to the depths shown on the enclosed channel depth chart and deeper along the bulkhead itself. (5) Finally,please be aware that the piers on the opposite side of the channel will result in the channel being made narrower,especially when boats are tied along these new docks. Also, your new bulkhead will be constructed outside of the existing bulkhead and that will unavoidably also result in making the channel narrower. In view of this, will you please ask the contractor of your bulkhead to try to construct the new bulkhead as close as possible to the existing one so that the channel can be kept as wide as possible for all of the boats using the channel? I believe this request is particularly important on the Southwest corner of the bulkhead because the resident at 234 Seacrest across the creek has constructed a pier which violates the pierhead line on the opposite shore by almost 14 feet and thus sticks way out in the channel. This pier is shown on the enclosed depth chart and I am sure you can see how critical it is to keep this bottleneck as wide as possible by trying to keep the corner of your bulkhead as far in as possible at this point.
