Dear David:
This will follow up our discussions relating to the
subdivision of property in Shandy Point recorded in Map
Book 35 at Page 101 of the New Hanover County Registry.
I have reviewed the following documents :
1 . Letter from Dexter Hayes to Mr. & Mrs . Barnes
dated April 12 , 2000 ;
2 . Deeds recorded in Deed Book 1050 at Page 291 ; Deed
Book 1162 at Page 1371; Deed Book 1382 at Page 537; and
Deed Book 1423 at Page 1579 .
3 . Aerial photograph of the property.
Based on my review of this information, it appears that
prior to subdivision the deeded property contained less
than 40, 000 square feet of land. Since this property is
located in an R-20 Zoning District, there was not adequate
square footage for the two lots . Therefore, the property

I have discussed this situation with the County Tax
Administrator. At the time that the lots are recombined
into a single lot of record, the Barnes' may apply for a
property tax refund based upon the error.
