DECLARATION OF RESTRICTIONS

TIE UNDERSIGNED, BOBBY M. IHARRELSON and JIMMIE L. SUGGS. are the owners of
of the interest and equity in that certain tract of land known as PLEASURE CAY
DIVISION, Section 1, and it is the desire of the undersigned, the developers, to
vent the impairment of the attractiveness of the property, to insure the use of
d property for attractive residential purposes only, to maintain the desired tone
the community and thereby to secure to each lot owner the full benefit and enjoyment
his home and property with no greater restriction upon the free and undisturbed

KNOW ALL HEN BY THESE PRESENTS
THAT WHEREAS, the undersigned are the owners of all those certain lots shown on a
map of Pleasure Cay Subdivision, Section 1, as recorded in Map Book 18, at Pages 74
and 74A of the New Hanover County Registry; and
WHEREAS, by instrument in writing recorded on Mae 12, 1978 in Book 1130 at Page
17SS of the New Hanover County Registry, Bobby W. Harrelson and Jimie L. Suggs,
the then owners of all of the lots in said Pleasure Cay Subdivision, Section 1
according to the map herein referred to caused a Declaration of Restrictions to be
recorded relating to said Pleasure Cay Subdivision, Section 1; and
WHEREAS, the undersigned have agreed to place certain additional covenants and
conditions upon the use of said Pleasure Cay Subdivision, Section 1.
NOW, THEREFORE, for and in consideration of the preaises and other good and valuable
considerations, the undersigned do hereby covenant and agree to and with all persons,
firms and/or corporations now owning or hereafter acquiring any property in Pleasure
Cay Subdivision, Section 1, that all of the lots in said subdivision as shown on the
map recorded in Map Book 18, at Pages 74 and 74A of the New Hanover County Registry,
are hereby made subject to the following additional restrictions, covenants and
agreements, running with the land by whomsoever owned, to-wit:
1. It is understood and agreed that Pleasure Cay Canal as shown upon the map
of Pleasure Cay Subdivision, Section 1, was designed to be maintenance free. However,
the owners of two-thirds of the front footage along said Canal, excluding any front
footage owned by Suggs and Harrelson Construction Company, Bobby M..Harrelson and
Jimmie L. Suggs, may elect to have maintenance pe: ormed up slid Looai: In sued-— •

event, all owners of property in said Pleasure Cay Subdivision,-Section 1, shall
be assessed for the cost of said maintenance, said assessment for each owner to be
based upon the percentage of ownership he owns upon said Canal in relation to the
total front footage along said Canal. Each assessment shall be paid by each owner to
the Trustee or Trustees hereinafter designated, with 30 days after written notification
of said assessment has been received from the Trustee by property owners. The Trustee
or Trustees shall have a lien upon property, in favor of other property owners. for the
cost of said assessment, until paid.
2. A. Until such tine as at least one-half of the total front footage of Pleasure
Cay Canal has been sold, Suggs and Harrelson Construction Company shall act as Trustee
for the collection of assessments, contracting for maintenance of Pleasure Cay Canal,
and paying, from assessments collected by it, for said maintenance.
B. At such tine as at least one-half of the total front footage of Pleasure
Cay Canal has been sold, Suggs and Harrelson Construction Company shall cease to act
as Trustee as herein stated, and shall promptly turn over all assessments held by it,
with proper accounting for any expenditures, to a coittee of three (3)•Trustees to
be elected by the owners (excluding Suggs and Harrelson Construction Company, Bobby
N. Harrelson and Jimmie L. Suggs) of the property fronting on Pleasure Cay Canal.
Each owner shall have one (1) vote for each front foot owned by him on Pleasure Cay Canal
in the seclection of the successor Ttwteee, and the three (3) persons receiving the
highest number of votes shall be elected to serve.
3. If the parties hereto, or any of them, or their heirs and assigns, shall violate
or attempt to violate any of the covenants herein, it shall be lawful for any other
person, or persons, firms or corporation owning any real property situated in said
subdivision to prosecute any proceeding at law or in equity against the person or
persons, firm or corporation violating or attempting to violate any such covenants,
