Enclosed for your review are the following for the referenced project:
• Three sets of drawing C-26 and SD-1
• Copies of Property Owner Notifications(2 properties)
• A Check from Seamist Camping Resort for$400 for the Application Fee
• One copy each of DOT Encroachment Agreement, State Stormwater Permit and COE Permit
The purpose of this project is to provide sewer to the Seamist Campground property. The project consists
of installing a wastewater pump station on the Seamist property and a sanitary sewer force main along
state roads to the Sea Trail wastewater treatment plant. These facilities have been planned and designed
in accordance with Brunswick County's master planning documents.
The pump station is not located within an area of environmental concern(AEC)and no construction
activities will take place within an AEC. The force main will cross the AEC associated with Goose Creek
at the point where the creek crosses under Brick Landing Road in two 72"CMP culverts(see attached
drawings). To avoid impact to the AEC,the force main will be installed by directional bore with bore
entry and exit both located outside the AEC in upland areas. The directional bore of approximately 253
linear feet will extend a minimum of 3' below the two culverts and will be located completely within the
NCDOT right-of-way. A copy of DOT encroachment E-010-2006-087 is attached. This project also has
approval from the Army Corps of Engineers under the general permit#198000291 and stormwater
approval per DWQ permit# SW8 060641,copies of both of which are attached. In addition,both
property owners that are adjacent to Goose Creek and the DOT right-of-way in the area of the force main
installation have been notified of the project,and evidence of those notifications is attached.
Based on our field discussions on June 28,we withheld submittal of this package since the general permit
is only valid for 90 days. We now have a schedule from the contractor and the boring subcontractor is to
begin work the week of November 27d'. Based on the tight schedule,anything you can do to expedite
approval will be appreciated. If you have any questions or require additional information please contact

Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally-
assisted programs of the U. S. Department of Transportation, Title 49, Code of Federal Regulations, Part 21, as they may be
amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and
made a part of this contract.
Nondiscrimination: The contractor, with regard to the work performed by it during the contract, shall not discriminate on the
grounds of race, color, or national origin in the selection and retention of subcontractors, including procurements of materials
and leases of equipment. The contractor shall not participate either directly or indirectly in the discrimination prohibited by
Section 21.5 of the Regulations, including employment practices when the contract covers a program set forth in Appendix B
of the Regulations.
Solicitations for Subcontracts, including Procurements of Materials and Equipment: In all solicitations either by competitive
bidding or negotiation made by the contractor for work to be performed under a subcontract, including procurements of
materials or leases of equipment, each potential subcontractor or supplier shall be notified by the contractor of the
contractor's obligations under this contract and the Regulations relative to nondiscrimination on the grounds of race, color,
or national origin.
Information and Reports: The contractor shall provide all information and reports required by the Regulations, or directives
issued pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its
facilities as may be determined by the Department of Transportation or the Federal Highway Administration to be pertinent to
ascertain compliance with such Regulations or directives. Where any information required of a contractor is in the exclusive
possession of another who fails or refuses to furnish this information, the contractor shall so certify to the Department of
Transportation, or the Federal Highway Administration as appropriate, and shall set forth what efforts it has made to obtain
the information.
Sanctions for Noncompliance: In the event of the contractor's noncompliance with the nondiscrimination provisions of this
contract, the Department of Transportation shall impose such contract sanctions as it or the Federal Highway Administration
may determine to be appropriate, including, but not limited to,
(1) withholding of payments to the contractor under the contract until the contractor complies, and/or
(2) cancellation, termination or suspension of the contract, in whole or in part.

This letter serves as adjacent riparian property owner notification for the submittal of a Coastal Area
Management Act(CAMA)permit for the construction of the Seamist Pump Station and Force Main
project. The project consists of the installation of a wastewater pump station at the existing Seamist
Campground property and the installation of an underground forcemain(pipeline). The forcemain will be
installed along Brick Landing Road,within the NCDOT right-of-way in front of your property.
The CAMA permit is required because the line will cross under Goose Creek. A directional bore will be
utilized so that Goose Creek and adjacent wetland areas will not be disturbed during construction. You
can see the extents of the directional bore in the attached figure. The remaining forcemain shown will be
installed in an open trench,and the ground above the pipeline will be returned to its pre-construction
state. All work will be accomplished within the NCDOT right-of-way adjacent to Brick Landing Road,
and the pump station and forcemain will be owned and operated by Brunswick County. Please review the
attached Seamist Pump Station and Force Main Project Layout Map for better understanding of the
proposed project.
Also attached you will fmd two copies of the Adjacent Riparian Property Owner Statement. Please fill

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules and Regulations

FOR THE
construction, operation and maintenance of a low density development in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules") and the approved stormwater management plans and specifications, and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a pall UI UIIJ permit.
The Permit shall be effective from the date of issuance until rescinded and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDARDS
1 . This permit covers the construction of 3,000 square feet of new built-upon area
for the pump station site only. The drainage area contains 68,600 ft2 of existing
BUA (dirt roads and temporary housing).
2. The overall tract built-upon area percentage for the project must be maintained at
25%, as required by Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are
incorporated by reference and are enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances
such as swales with minimum side slopes of 3:1 (H:V) as defined in the
stormwater rules and approved by the Division.

II. SCHEDULE OF COMPLIANCE
1. Projects covered by this permit will maintain a minimum 30 foot wide vegetative
buffer between all impervious areas and surface waters.
2. The permittee is responsible for verifying that the proposed built-upon area does
not exceed the allowable built-upon area.
3. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
5. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division of Water Quality.
6. Construction of additional built-upon area in excess of the permitted 3,000
square feet within the 7.8 acre project area will require a permit modification.
7. Construction of additional impervious areas such that low density requirements
are no longer met must be submitted to DWQ and a permit modification must be
issued prior to construction. An suitable engineered system will be required to
collect and treat the runoff from all built-upon area associated with the project,
including that area permitted under the low density option. This may or may not
be permitted, depending on the suitability of the soils for infiltration.
8. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with this development, except for average driveway crossings, is
strictly prohibited by any persons.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans , including, but not limited to, those listed
below:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built-upon area.
e. Further subdivision, acquisition, or sale of the project area. The project
area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the
approved plan.

14. The permittee shall at all times provide the operation and maintenance
necessary to operate the permitted stormwater management systems at optimum
efficiency to include:
a. Inspections
b Sediment removal.
c. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality,
in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance, or
termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules, and regulations contained in Title 15A of the North
Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. This permit is not transferable except after notice to and approval by the Director.
The Director may require modification or revocation and reissuance of the permit
to change the name and incorporate such other requirements as may be
necessary. A formal permit request must be submitted to the Division of Water
Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of
this request will be considered on its merits, and may or may not be approved.
The permittee is responsible for compliance with all permit conditions until the
Director approves the transfer.
6. The permittee grants permission to DENR Staff to enter the property for the
purpose of inspecting all components of the stormwater management facility.
7. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
8. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by

The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions,outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number,size and the allowable built-upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state storm water management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt,gravel,concrete, brick,stone,slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in,piped,or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state storm water management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the storm water control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
