Dear Mr. Mairs:
On Friday, July 14, 2006, I received a letter by certified mail, from Mr. Dennis Chisum. Items
included in the mailing are as follows:
1. required CAMA Permit Notification with Mike Hoffer, Local CAMA Permit Officer,
identified as the contact person,
2. Division of Coastal Management, Adjacent Riparian Property Owner Notification/
Waiver Form, and
3. new CAMA/Dredge and Fill General Permit No. 43281-D.
After careful review of all of the information that has been submitted relative to this project, I do have
objections to yet another revision. The permit should be denied for several reasons, including the
following:
1. On August 18, 2005, The Bayview Manor Home Owners' Association submitted an
objection to a previous permit request. Objection 3 stated, "Furthermore, in consultation with
staff of the Army Corps of Engineers, we have reservations regarding the legality of the
proposed-{and existing)bulkhead. The current bulkhead is in violation of CAMA regulations
..."In other words,the present bulkhead was never approved by CAMA. The only approved
bulkhead on this property is-approximately 2 to 4 feet behind the illegal bulkhead. Why would
a new bulkhead be approved extending another 2 feet into the water? This would make a total
extension of 4 to 6 feet from the only approved bulkhead.
2. As I understand,the original permit for the proposed project was approved with an off set
of 30 feet as required by CAMA regulations from the high water mark. If a new bulkhead is
built 2 feet in front of the old bulkhead,you have Extended the property off set by 2 feet. This
could allow for decks, permanent structures, swimming pools, etc. to be adjusted based on

location as indicated. However, I do object to the plans if a new permit is approved extending
the bulkhead 2 feet into the water. Therefore,I am of the impression the project would return
for consideration by the planning and zoning commission and the Carolina Beach Town
Council.
4. As this project developed, I am assuming engineers, marine construction companies,
builders, and state and local officials were involved in the review process. The present
bulkhead was in all of the plans that have been submitted and approved. One would assume
that plans were submitted/approved based on a complete analysis of the old bulkhead—just
as we would hope that the new structure plans have been developed/approved by engineers,
architects, etc. Why are we now being asked to approve a 2 foot bulkhead extension? Why
not replace the old bulkhead or better yet, simply, build a new bulkhead where the only
approved bulkhead is located, approximately 2-4 feet behind the present bulkhead.
5. The required CAMA form I received is not the proper form(copy enclosed).
As I have previously stated; I applaud the efforts of Drs. Joe and Cathy Kosterman to "beautify this
area with an upscale property on the site." However, I find it difficult to believe a review was not
conducted prior to the developmept/submission/approval of plans relative to the condition of the
present bulkhead.
