Dear Mr. Mairs:
As per our earlier telephone conversation, I am enclosing the Division of Coastal
Management Adjacent Riparian Property Owner Notification/Waiver Form. While I
applaud the efforts of Drs. Joe and Cathy Kosterman to "beautify this area with an
upscale property on the site", I do have some concerns.
Please consider the following:
1. Bulkhead revisions need to be more detailed. There are no specific
measurements, widths, lengths, etc. it seems appropriate to me that a more
detailed plan be required before I can make a final decision.
2. As stated in the letter we received from Dorothy H. Dale, Realty World
Coastal Properties, I am being asked to approve "bulkhead and dock
revisions" at 1303 Canal Drive. Therefore, I am of the opinion that in keeping
with the intent of Coastal management regulations, the correct interpretation
would require that all properties comply with CAMA requirements. As I
stated in our phone conversation, this would include the removal of three
pilings and a floating dock on the south side of the property. Furthermore, I
am not aware of any approval given to have the pilings on the property. Also
the floating dock is relatively new (within the last three years) and I am not
aware of any required waiver to install said floating dock.

To Whom It May Concern:
We are writing in response to the Division of Coastal Management Adjacent
Riparian Property Owner Notification/Waiver Form (attached) requesting
approval for proposed development of the adjacent property owned by Joseph A.
and Cathy B. Kosterman, 1303 Canal Drive, Carolina Beach, New Hanover
County, North Carolina 28428. We hereby certify that we own property adjacent
to the 1303 Canal Drive property referenced here and on the attached forms. We
DO HAVE OBJECTIONS to this proposal for the following reasons:
1. We did not receive the documentation and accompanying form until late in
the day of August 17, 2005 because the submitter did not send it directly
to the Bayview Manor's Home Owners' Association President.
2. The Bayview Manor Home Owner's Association objects because, in
consulting with an engineer who is also a Director of the Homeowner's
Association, we determined that:
a. The documentation submitted does not include a legend or
otherwise sufficient information to determine what we are being
asked to support.
b. Despite the cover letter attesting to this being a request to approve
a proposed structure and other changes to the property to "beautify
this area with an upscale property on this site" (see attached) there
is no description, detailed plan or other adequate documentation

proposed changes to the bulkhead should restore the bulkhead to the position of
the CAMA setback requirement rather than perpetuate this violation, as currently
proposed.
In summary, for the reasons listed above, we DO NOT APPROVE of the proposed

Hanover County, North Carolina 28428.
