Gulf Stream Marina, Inc. dba Airlie Marina, Wilmington,NC
Dear Robb:
As we have previously discussed on site, I plan to renew the existing piers and pilings as
part of routine maintenance prior to conveying the marina to the members of Airlie Yacht
Club, Inc., a non-profit boat owners association.
I have enclosed a sketch of the proposed replacement in like and kind of the existing pier
and pilings.New finger piers are proposed as indicated. The replacements will stay
within the existing footprint originally approved by the U.S. Army Corps of Engineers in
February 1977 (copy attached) and the easement granted by the State of North Carolina
in April 1997. The number of slips will be 26-28, which is less than existing.
I am applying for a general permit and will be glad to meet with you on site again if
necessary. Please advise of the application fee and any further action required on my part.

Gentlemen:
In accordance with your written request of 18 November 1977 and the
ensuing administrative record, there is inclosed a permit authorizing
you to construct new piers and bulkhead on the Atlantic Intracoastal
Waterway (AIWW) near Wrightsville Beach in New Hanover County, North
Carolina.
If any material changes in the location or plans of the structure or
work are found necessary on account of unforeseen or altered conditions
or otherwise, revised plans should be submitted promptly to the District
Engineer so that these revised plans, if found unobjectionable, may be
approved before construction begins.
Condition (n) of the inclosed permit requires the permittee to notify
this office of the commencement and completion dates. Should you
require time beyond that allowed to commence or complete your work,
please submit a timely written request for permit modification.
The inclosed Notice of Authorization must be conspicuously displayed at

Dear Tom,
I am in receipt of your"Notice of Request"to CAMA to replace your docks and pilings
on Airlie Road. In general, I have no objection to this project,however, only if the
placement and alignment on your new tie pilings and docks are in conformance with
CAMA rules relative to set-back from my riparian property line. As you are aware, I
granted a temporary easement to MJR Properties for the location of pilings which are
within the 15' set-back on my side until the property was sold or the docks were replaced.
As you and I agreed, now is the time for that re-alignment to take place.
Your submittal and plan from the original Corps of Engineer's permit, dated 18
November 1977 is an accurate and legal lay-out of these docks and tie pilings. Note that
the dock is shown 35' from the adjacent property line(mine)and bow pilings are shown
15' off the property line extension with slips to provide dockage for 20 foot boats. Other
plans that you sent are not as clear in these set-backs and I wish to be assured that the
placement of these pilings will be in agreement with your original plan.
Thank you for allowing me to comment on this lay-out. It should be a good project for
the group.

SUBJECT: Commander's Policy Memorandum# 5 - Setbacks Along Federally Authorized
Waterways
1. Purpose. This memorandum provides general policy and guidance for setbacks of piers,
docks, or any other waterfront structures constructed along federally authorized and maintained
navigation channels within the U.S. Army Corps of Engineers, Wilmington District. It is the
intent of this policy to both equitably manage the construction of structures along the Federal
channels while preserving the Government's ability to maintain such waterways.
2. Applicability. This policy applies to all permit applications received after the date of this
memorandum, pursuant to Section 10 of the River and Harbor Act, 33 USC Section 403, and
potentially Section 404 of the Clean Water Act for the construction and placement of docks,
piers, and other structures along federally authorized and maintained shallow draft navigation
channels within the Wilmington District. This policy will not apply to federal projects that have
established harbor and pierhead lines or where setbacks have been established by law. This policy
statement is internal Wilmington District guidance; it is not a permit to be utilized by the public.
3. Definitions. Shallow Draft Navigation Channels are federally maintained navigation channels
with project depth dimensions less than 18 feet mean low water.
4. General. The following setbacks are designed to ensure that no structures encroach beyond the
top edge of the navigation channel and that there is sufficient clearance for dredging the
navigation channel.
a. No permit shall be issued for any pier, dock, or other waterfront structure extending
any closer to the near bottom edge of the Federal channel than the sum of three times, the project
depth plus two feet overdepth, plus ten feet. (Example: 6-foot project+ 2-foot overdepth= S
feet x three+ 10 feet= 34-foot setback from near edge of channel.)
b. Atlantic Intracoastal Waterway. No permit shall be issued for any pier, dock, or other

eighty(80) feet with the exception of official "NO WAKE ZONES" approved by the Corps. In
these areas of"no wake," no pier, dock, or other waterfront structure shall extend any closer than
fifty(50) feet to the near bottom edge of the Federal channel.
