He is our adjacent neighbor to the north. We are relieved to find that the dock does not appear to encroach on the normal 15-foot riparian setback between his lot 16 and our lot 17. You can imagine my surprise, however, to discover that Mr.Connaway,Mr.Calhoun's dock builder and our neighbor to the south, fraudulently signed your department's"Owner Notification/Waiver Form" on March 28,2006 (see copy). In fact,Mr. Connaway was never the owner of the property adjacent to Lot 16, and as evidence of our ownership as of Feb. 15,2006, 1 have attached a copy of the recorded deed for lot 17. You can see that Mr. Oden and myself purchased lot 17 from Mr. Calhoun's company,Calhoun Investments. Mr. Connaway is owner of lot 18 located two lots south of Mr. Calhoun's lot 16 as of the date of March 28,2006. I'm not sure where this leaves Mr. Connaway since not only was he not the adjacent property owner at the time he signed the form, but he stood to personally gain monetarily in the form of a dock contract for Mr.Calhoun. Furthermore,as the seller of both lots 17 and 18,Mr.Calhoun was fully aware that Mr. Connaway was not his adjacent neighbor to the south when he applied for his dock permit. Stranger still is the fact that we were never approached about signing this form at all,and thus there was no reason for Mr. Connaway and Mr.Calhoun to try to sidestep us as rightful adjacent land owners. We need to refer the matter to our attorney for further investigation, but we would ask that the permit process be suspended until the paperwork is properly obtained and signed by the rightful parties involved. You can also pass my numbers on to Mr. Calhoun should he desire to discuss the matter directly. Also, can you please fax me a copy(762-0783)of the riparian setback waiver for Mr. Connaway's lot 18 that allowed him to encroach the southern riparian setback of our lot 17? This waiver was never disclosed to us as buyers,and we want to see the documentation especially in light of the questionable actions above.
