Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that [)prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

This letter is in response to your correspondence received by the Division of Coastal Management dated
received on December 27, 2006 regarding your concerns about the proposal by Scott and Holly Webster to
construct a new private pier, platform, floating dock and single pole boatlift adjacent to Howe Creek. at 6322
Timber Creek Lane, Wilmington, in New Hanover County. The constructing of the fixed pier. platform.
floating dock and single pole boatlift has been determined to comply with the Rules of the Coastal
Commission (7H.1200)- General Permit for construction of piers, docks, and boat houses in the LStU,11.111V
Shoreline AEC, and as such, a permit has been issued to authorize the development. I have enclosed a cop} of
the permit, as well as, the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party_ Hearing.
The request for a hearing will be considered by the Chairman of the Coastal Resources Commission. The
hearing request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days after the disputed permit decision is made. I have enclosed the applicable

Several issues cause me to deny approval of Webster's dock at 6322 Timber
Creek Lane.
When I asked CAMA to approve my dock, the agent explained that the shore line
and riparian rights excluded 6322 Timber Creek Lane for a dock. I would
appreciate an interview with CAMA to explain the change on this position.
The creek deep water point tends to be toward the north side of the creek in the
area of the proposed dock. With reference to the drawing submitted to me by the
Webster's the mean low tide will be several feet under the proposed structure.
With or without the illustrated boat tied to the pylon dock or floating dock the
access to deep water at mean tide or low tide will restrict boat traffic. Row boats,
kayaks, and canoes will be restricted plus all larger boats.
I request an interview in early January 2007 due to the Christmas and New Years
holiday.
