These three new options have very little changes from the first set except they appear to be more in front of his(Sheffield's)property instead of the neighboring property owner's at Lot 137-D. Again, we are objecting to his proposals for the very same reasons addressed in our letter to you dated March 8, 2007. (Please see attachments). And we will continue to object to this proposed construction into the marsh. I oppose what Ron is trying to build because of the damage, even a small boat will do to the shellfish beds, fish spawning and nursery areas. I live on the' point across from Ron and can tell you that you can't run a boat in & out of this cove without damage to shellfish beds and aquatic vegetation. The water depth in the creek at Ron's house is not the point----it's that the creek flattings out in the center of the cove and there is no creek for some distance. Even at high tide there will be significant damage. I have watched Ron trying to dredge the creek with his outboard motor. I hope that we won't continue to allow this kind of irresponsible behavior. Applicant's proposed pier and decking covers over 900 sq. ft. of pristine marsh which will result in a loss of this habitat. No structures exist in the pristine marsh habitat from the mouth of this estuary to the causeway(+or—20 acres). This marsh is a habitat to Bald Eagles,hawks,ospreys,wading birds, and owls. It is also a nursery area to shrimp, oysters, clams, and a multitude of fish species and crustaceans. This habitat will be negatively impacted by the applicant's proposed construction. One of my neighbors, Chuck Wood, who lives across the marsh, forwarded his objections to this construction to you via e-mail,dated 3/2/2007. (A photocopy of this e-mail is attached for your review. Attachment #1) The creek traversing the marshland is impassable to boat traffic except during one to two hours at high tide. Mr. Sheffield has been observed running a Jon boat in the creek in front of his property at a tide that allowed the propeller wash to disturb the creek bottom in an apparent attempt to deepen the creek. The drawings provided to me by the applicant(attachment#2)are not drawn to scale but should be to show true property E.I.Ps and property line bearings, so that a proper review of this application can be performed. In my opinion,the applicant has eschewed the"imaginary in marsh"property line between applicant's property and the Rodovsky property(lot 137-D)to encroach on the marsh in front of the Rodovsky property(see attached property plat of lots 137-B, 137-C, and 137-D. Attachment#3). Page 2, Mr. Jim Gregson The 15' Riparian setback is not clear and not to scale on Mr. Sheffield's proposed development drawing. I request this marshland be considered an area of Environmental Concern and appropriate action be taken by NCDENR to that end. In addition, property owners on the marsh from the causeway to Mr. Sheffield's property have expressed opposition to this construction. Applicant's proposed pier and decking covers over 900 sq. ft. of pristine marsh which will result in a loss of this habitat. No structures exist in the pristine marsh habitat from the mouth of this estuary to the causeway (+or—20 acres). This marsh is a habitat to Bald Eagles, hawks, ospreys, wading birds, and owls. It is also a nursery area to shrimp, oysters, clams, and a multitude of fish species and crustaceans. This habitat will be negatively impacted by the applicant's proposed construction. One of my neighbors, Chuck Wood, who lives across the marsh, forwarded his objections to this construction to you via e-mail, dated 3/2/2007. (A photocopy of this e-mail is attached for your review. Attachment #1) The creek traversing the marshland is impassable to boat traffic except during one to two hours at high tide. Mr. Sheffield has been observed running a Jon boat in the creek in front of his property at a tide that allowed the propeller wash to disturb the creek bottom in an apparent attempt to deepen the creek. The drawings provided to me by the applicant (attachment#2) are not drawn to scale but should be to show true property E.I.Ps and property line bearings, so that a proper review of this application can be performed. In my opinion, the applicant has eschewed the "imaginary in marsh" property line between applicant's property and the Rodovsky property (lot 137-D) to encroach on the marsh in front of the Rodovsky property (see attached property plat of lots 137-B, 137-C, and 137-D. Attachment#3). Page 2, Mr. Jim Gregson The 15' Riparian setback is not clear and not to scale on Mr. Sheffield's proposed development drawing. I request this marshland be considered an area of Environmental Concern and appropriate action be taken by NCDENR to that end. In addition, property owners on the marsh from the causeway to Mr. Sheffield's property have expressed opposition to this construction.
