violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .

This letter is in response to your correspondence received by the Division of Coastal
Management on April 3, 2007, regarding your concerns about the proposal by The Land
Company of Pender County, LLC to construct a bulkhead adjacent to Horn Creek, at the
property adjacent to the Washington Acres boat ramp, off Hughes Road, in Hampstead, Pender
County. The project consists of the construction of a bulkhead landward of normal high water
and landward of Coastal Wetland vegetation. The proposed project has been determined to
comply with the Rules of the Coastal Resources Commission(7H.1100), and as such, a permit
has been issued to authorize the development. I have enclosed a copy of the permit, as well as
the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal
Resources Commission. The hearing request must be filed with the Director, Division of Coastal
Management, in writing and must be received within twenty(20) days after the disputed permit

Dear Heather:
I would like to comment on the general permit request from Mark Clements regarding the bulk-
heading of the boat ramp at Washington Acres. Mr. Clements is acting as agent for The Land
Company. Although I am not an adjacent property owner,this request will have an impact on my
property and the character of the neighborhood. Bulkheading, resulting in additional parking,
will increase vehicle traffic,parking,and runoff far and above the permitted existing commercial
usage.
I understand that a general permit only allows 500 feet of bulkhead,but it is public knowledge
that The Land Company intends to bulkhead the entire basin. I feel applying for a general permit
is an attempt to circumvent major permit requirements, which is The Land Company's objective.
In the future,additional general permits will be applied for to complete this work. Past
experience has been this same development group applying for one objective,with an overall
plan completely different than initially stated. (i.e. the sand mine on Washington Acres Road).
Secondly, I have storm water runoff concerns regarding the additional parking that this
bulkheading will create,with drainage directly into O.R.W. waters. Heavy rains can be
witnessed draining directly into these waters now,and it would be prudent if storm water runoff
was involved through the major permitting process. After reviewing Mr. Clements's plan, I
found it to be very vague and inaccurate, and hope a more accurate detailed plan will be required,
including overall objectives.
The community would like to thank you in your efforts to protect these valuable resources. I
would also like to be advised as to the outcome of this permit.

Heather, I inadvertently caused my incomplete e-mail to you to be sent prematurely. Here's the
balance of my comments.
As far as the bulkheading is concerned, we need assurance that the work will not impede access to or
the use of our pier and ramp access to our floating dock(all of which are located at the riparian
boundary between our property and Lot#100.)The sketch provided with the Notice is not clear as to
this issue.
Our information is that the intention of the Land Co. is to bulkhead the entire periphery of the Long
Point Estates canal, a scope considerably greater than that shown on the sketch we have been
provided(and for which I understand a major permit should be required because the length will be in
excess of 500 ')

from Clements Marine Construction acting as Agent for the Land Co.,regarding the proposed
installation of a fence along the property line of Lot#100, (contiguous with our boat ramp area), the
removal of the picnic area shelter, and the installation of bulkhead along the upland periphery of the
shore-line enclosing Lot#100.
I understand the issue of the fence and the shelter to be the minor permit province of Pender County
Planning(Andrew Collins 259-1408) and not CAMA and it is to Mr. Collins that we should address
our concerns.
