Roanoke Way, Nags Head Dear Mrs. Whitson and Mr. Whitson: This letter is in response to your objection as an adjacent riparian property owner to a permit request from John and Stephanie Watkins for the construction of a docking facility at 4728 S. Roanoke Way in Nags Head, Dare County. Yvonne Carver, of the Division of Coastal Management staff, was recently on site to evaluate the permit applicant's request. The permit applicants have requested a permit to construct a pier with upper and lower platforms and 2 boatlifts. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) have established Rules for General Permits for these types of development that are found in 15A NCAC 07H.1200. Mrs. Carver forwarded copies of these applicable rules to you, Mrs. Whitson, via email on August 3, 2020. You have notified the Division of Coastal Management of your objections to this proposed development by checking "I have objections to this proposal" on the Adjacent Riparian Property Owner Statement form, as well as a formal objection letter dated July 24, 2020. Your objections to this proposed development relate to navigation, scouring of the water bottom during storm events, debris generated during storm events, safety concerns for recreational water uses in the area, and the depth of the Sound bottom. You also chose not to waive the 15-foot setback. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this type of development. Roanoke Way Nags Head, NC 27979 i`MmA As an Adjacent Riparian Property Owner at 4730 South Roanoke Way; Lot 54, Section B; Old Nags Head Cove, I have the following objections to the 6' X 88' pier, 12' X 16' platform with a lower L-shaped dock, fish cleaning table and boatlifts "Project" proposed by John Watkins for his lot at 4728 South Roanoke Way, Nags Head, NC 27959: 1) The Project will block navigable waters and prevent boat access to the preexisting dock on our property. Our dock was constructed to the largest permissible size that could be permitted in its location at the time of construction. It will be effectively walled off upon completion of the Project. 2) The Project will cause scouring of the Roanoke Sound bottom at its location and in areas adjacent to it, especially during the periods of strong, Northwesterly winds that are frequent in hurricanes and winter storm events impacting the Nags Head area. The scouring will cause undermining of our preexisting dock and bulkhead and promote severe erosion of our land. 3) There is a high likelihood that the Project will generate debris during Northwesterly storm events. Such debris has the potential to cause severe damage to structures on our property. 4) Swimming and other recreational water uses by persons (including small children) take place in the area adjacent to the location of the Project. Fish cleaning in the vicinity will attract predatory marine animals that will endanger people engaged in these activities.
