THIS AGREEMENT, made and entered into this the /o- day of /V/dlrn,4 e r
2008, by and between the CITY OF SOUTHPORT, hereinafter referred to as "CITY "; and
RIVERSIDE MOTEL, INC., ROY C. DANIEL, JR., and wife, CHERYL DANIEL, and JOHN
RICHARD DOSHER and wife, ROBERTA DOSHER, all hereinafter referred to as "PROPERTY
OWNERS":
WITNESSETH :
THAT WHEREAS,CITY is the owner of a certain tract of land located on the south
side of Bay Street in Southport known as tax parcel 237LH05102 which tract is bounded on the
south by the Cape Fear River; and
WHEREAS, CITY desires to undertake a project to stabilize its shoreline along the
southern line of said property in order to control the erosion thereof; and
WHEREAS, in order to properly and effectively stabilize and protect its own
shoreline,it will be necessary to also stabilize and protect the shoreline of certain adjacent property
owners; and

WHEREAS, PROPERTY OWNERS , realizing the benefit to their respective
properties, have agreed to allow CITY to perform said stabilization project along the shoreline of
the properties owned by PROPERTY OWNERS upon the following terms and conditions;
NOW,THEREFORE,for and in consideration of the mutual covenants,conditions
and stipulations set forth herein, the parties hereto do agree, covenant and stipulate as follows:
1. CITY shall install or have installed at CITY's sole cost and expense the necessary
rip rap along PROPERTY OWNERS' property lines which adjoin the Cape Fear River on the
above-described parcels in order to stabilize said shoreline and control the erosion of their respective
properties. All parties agree that this will benefit and protect the properties owned by CITY and
PROPERTY OWNERS.
2. PROPERTY OWNERS hereby grant and convey to CITY the perpetual right and
easement to go upon PROPERTY OWNERS'respective properties above-described for the purpose
of installing,repairing,maintaining and replacing said rip rap.It is understood,however,that nothing
herein shall bind or obligate CITY to repair or replace said rip rap after the initial stabilization
project and CITY assumes no liability or responsibility therefor.
3. It is further understood and agreed that CITY can not and does not guarantee the
effectiveness of said stabilization project although CITY does agree to use its best efforts to have
said rip rap installed in a proper and workmanlike manner.
4. CITY hereby agrees and covenants to use its best effort not to disturb or damage
the respective properties of PROPERTY OWNERS any more than is reasonably necessary to
properly complete this stabilization project and to perform any necessary maintenance, repair or
replacement. Notwithstanding this,however,PROPERTY OWNERS acknowledge and agree that

5. All parties acknowledge and agree that this stabilization project is for the mutual
benefit of all parties, and all parties hereby agree and covenant to be jointly liable and responsible
for any CAMA violations.
IN WITNESS WHEREOF, the parties have executed this agreement in duplicate
originals as of the day and year first above written.

Daniel tract
Known as Waterskirt No. 5 and being situated on the south side of
Bay Street opposite Lot No. 5 as shown on a plat or map of the City
of Southport and more particularly described as follows; BEGINNING
at a point on line of the south side of Bay Street where the line
of the east side of Lord Street if projected would intersect the
same, and running thence along the said southern line of Bay Street
in an eastwardly direction 66 feet to a point where that line would
be intersected by the dividing line between Lot No. 5 and Lot No.
6 if projected, thence in a southerly direction along said
projection of the dividing line between Lots 5 and 6 to the channel
of the Cape Fear River; thence down the channel of the Cape Fear
River to a point where it intersects and crosses the projection of

Beginning at a point in the Southern right-of-way of West Bay Street which said point is

River;runs thence with the high water mark of the Cape Fear River in an Eastwardly direction to a
