I hereby certify that I own property adjacent to the above-referenced property. The individual
applying for this permit has described to me as shown on the attached drawing the development they
are proposing. A description or drawing, with dimensions, should be provided with this letter.
I have no objections to this proposal.
If you have objections to what is being proposed, please write the Division of Coastal
Management, 127 Cardinal Drive Extension, Wilmington, NC 28405 or call 910-796-7215
within 10 days of receipt of this notice. No response is considered the same as no objection if
you have been notified by Certified Mail.
WAIVER SECTION
I understand that a pier,dock, mooring pilings,breakwater,boat house or boat lift must be set
bck a minimum distance of 15' from my area of riparian access-unless waived by me. (If you
wish to waive the setback, you must initial the appropriate blank below.)
I do wish to waive the 13' setback requirement.
I do not wish to waive the 15' setback requirement.

Attached please find the waiver/permit that was sent to us while we were out of town. It was
certified mail and we did not sign for it until August 8, 2008. We want to make sure that you
have this documentation.
We do not agree to this waiver and want you to be aware of that.
Also included is a letter we have sent to Mr. Grimes and Mr. Hamby,
Thank you for your help. If you have any questions please call us. We would like to have a
confirmation that this permit has not been and will not be allowed. We need the set back to
remain as per DCM regulations.

Dear Mr. Grimes, •
I am contacting you in regard to the certified mailing sent to me by you, and received by me on
August 8, 2008.
Enclosed was a setback waiver form/application filled out on behalf of Robert Hamby,
Southport.
I could not possibly agree to sign such a document, mainly due to the absence of any attached
correspondence, and/or any explanation of your intentions. Moreover, to grant this waiver is
something I would never ask of Mr. Hamby.
And so, let us adhere to the current 15 foot setback, as per DCM regulations.
