Dear Ms.Price:
This letter is being sent in response to your verbal complaint by phone on August 20,2009 and the
complaint letter received by email on Monday August 31,2009. This letter is also being sent as an informal
compliance assistance notice concerning the relocation of a jet-ski lift adjacent to the existing pier located at 414
Loder Avenue,Wilmington,New Hanover County. The pier and lift are located within the Public Trust Waters and
Estuarine Waters Areas of Environmental Concern(AEC). Please be advised that the existing pier and jet-ski lift
were authorized by CAMA General Permit#5208ID and in accordance with the Rules set forth in 15A NCAC
7H.1200. The location of the lifts are shown on the permit drawing,authorized and issued on March 14,2008. A
site visit was conducted on September 24,2009 to determine compliance with the issued permit. In response to your
written complaint that the lift has been recently relocated,my findings in the field have determined that the lifts on
both the north and south side of the existing float are in the authorized location. At this time the pier located at 414
Loder Avenue is in compliance and the location of the lifts would not result in a violation of CAMA General Permit
#52081. Please be advised that 15A NCAC 7H.1205(a)General Conditions for the Construction of Docks and
Piers,specifically states that"piers and docking facilities authorized by this general permit shall be for the exclusive
use of the land owner,or occupant and shall not be leased or rented or used for any commercial purpose".
With regards to your phone complaint that a barge operated by Jeff Terry of Above Par Construction has been
moored adjacent to the docking facility preventing access to the south side slip. Generally these work barges are not
tied to existing piers and are held in place by spuds.For CAMA purposes work barges are therefore not considered
boats/vessels or slips. Work barges that are not permanently located in an area for more than 30 days are not
regulated by current CRC Rules. Jeff Terry has been compliant,and has responded to contact from this office
regarding the location of the barge. He has also worked in good faith to keep his barge from being permanently
located in one area for more than 30 days.
I hope this letter fully addresses your concerns and I thank you for your attention regarding this issue.
