FILMING TERMS AND
CONDITIONS
1. Activities that violate any North Carolina Parks and Recreation Regulations may
not be filmed without the approval of the Park Superintendent.
2. Permittee will insure minimum disruption of public visitation and recreational
activities. Permittee is allowed to restrict public use, as reasonably necessary,
only during actual filming and other critical production activities. During these
times, permittee will be allowed to direct pedestrians and vehicles away from the
filming area.
3. The Park Superintendent has full enforcement authority on any conditions
established and agreed to in this permit and approval of any changes requested
by the permittee.
4. The permittee, their employees and contractors will observe and abide by all park
rules and regulations and any special conditions specified by the Division of Parks
and Recreation.
5. Electrical power to the filming site is the sole responsibility of the permittee and
the location of any temporary lines and poles will be approved in advance by the
Park Superintendent. The removal of all temporary installations will be the
responsibility of the permittee.
6. All litter, debris and other waste materials will be picked up or cleaned daily.
Waste materials will be disposed of off-site.
7. The permittee will meet with the Division staff immediately upon cessation of
filming activities to evaluate the impact of the filming activities and to insure park
lands and facilities are left in the condition they were prior to filming.
8. All filming and production work will be completed within the time frame outlined
within the permit.
9. Permittee will provide proof of General Liability insurance sufficient to protect the
State and it employees from claims or litigation connected with injury or damage
resulting from the actions of the permittee or his agents and employees.
10. Resident wildlife may be photographed, but only when such wildlife is not
molested, harmed or disturbed thereby. Wildlife captured elsewhere may not ha
official in charge of the park.
12. No employee of the Division of Parks and Recreation may work for the permittee
in any capacity while in uniform or if directly involved in the supervision of the
permittee.
13. No personal gratuity of any nature will be offered to any governmental employee
in connection with the exercise of the privilege granted under this permit.
14. Park staff will supervise all filming within park boundaries, and will have the
authority to make all supervisory decisions to insure compliance with the permit
and applicable regulation.
15. Park staff is not responsible for the security of vehicles left in the parking lot
overnight.

The permitee agrees to the following permit fees:
1. Special Activity Permit fee: $30
2. 4WD permit fee ($10 x the number of vehicles or $40 for an annual pass per
vehicle).

SPECIAL ACTIVITY PERMIT-ATTACHMENT- Description of Events &Activities
GOF Productions,LLC. Would like to access the parking lot,Basin Trail,4-Wheel Drive Access Road
and Spur,and Beach for the purposes of filming scenes for the motion picture entitled,"A Good Old
Fashion".
The company would like to access the areas prior to filming to construct a beach shack on the beach
and temporarily install approved native grasses along the 4x4 spur(opposite the Basin Trail access).
The Company would like to film scenes for the film along the Basin Trail and on the Beach for 3 days
(June 9,10,11). On the filming days the company would like to park production trucks in the main
parking lot and access the beach with equipment and personnel via 4x4 vehicles.(Company will
purchase the appropriate permits for each vehicle)
The following is a detailed schedule of times,dates and activities that we would like to request in this
permit. A map illustrating the areas is attached.
Thursday&Friday-June 5&6,2008
8AM-6PM
Prep crew accesses beach and spur area to install beach shack(illustration attached)and native
grasses along spur in order to simulate appearance of a footpath.
Crew: 5-10
Vehicles: 3-5 4X4 pick-up trucks
Production Company will place an unarmed security guard on the beach shack site for the weekend.

SECTION.1900—GENERAL PERMIT TO ALLOW FOR TEMPORARY ST5UCTURES WITHIN COASTAL
SHORELINES AND OCEAN HAZARD AECS
15A NCAC 07H.1901 PURPOSE
A permit under this Section shall allow for the placement of temporary structures within estuarine and public trust shorelines,
and ocean hazard AECs according to the provisions provided in Subchapter 7J .1100 and according to the rules in this
Section.

15A NCAC 07H.1902 APPROVAL PROCEDURES
(a) The applicant must contact the Division of Coastal Management and complete a general permit application form
requesting approval for development. Applicants shall provide information on site location,dimensions of the project area,
proposed activity,name,address,and telephone number.
(b) The applicant must provide:
(1) confirmation that a written statement has been obtained signed by the adjacent riparian property owners
indicating that they have no objections to the proposed work;or
(2) confirmation that the adjacent riparian property owners have been notified by certified mail of the proposed
work. Such notice should instruct adjacent property owners to provide any comments on the proposed
development in writing for consideration by permitting officials to the Division of Coastal Management
within ten days of receipt of the notice,and,indicate that no response will be interpreted as no objection.
DCM staff will review all comments and determine,based on their relevance to the potential impacts of the
proposed project,if the proposed project can be approved by a General Permit. If DCM staff finds that the
comments are worthy of more in-depth review, the applicant will be notified that he must submit an
application for a major development permit.
(c) No work shall begin until an onsite meeting is held with the applicant and a Division of Coastal Management
representative to inspect and mark the site of construction of the proposed development. Written authorization to proceed
with the proposed development may be issued by the Division during this visit. All work must be completed and the structure
removed within 180 days following the day written authorization is issued.

07H.1903 PERMIT FEE
The applicant shall pay a permit fee of two hundred dollars($200.00)by check or money order payable to the Department.

15A NCAC 07H.1904 GENERAL CONDITIONS
(a) Temporary structures for the purpose of this general permit are those which are constructed within the ocean hazard or
estuarine system AECs and because of dimensions or functions do not meet the criteria of the existing general permits(i.e.are
not a bulkhead,pier,rip-rap,groin,etc.).
questions concerning the proposed activity's impact on adjoining properties or on water quality;air quality;coastal wetlands;
cultural or historic sites;wildlife;fisheries resources;or public trust rights.
(e) Individuals shall allow authorized representatives of the Department of Environment and Natural Resources to make
periodic inspections at any time necessary to ensure that the activity being performed under authority of this general permit is
in accordance with the terms and conditions prescribed herein.
(f) This permit does not eliminate the need to obtain any other state, local or federal authorization, nor, to abide by
regulations adopted by any federal, state,or local agency.
(g) Development carried out under this permit must be consistent with all local requirements,and local land use plans current
at the time of authorization.

15A NCAC 07H.1905 SPECIFIC CONDITIONS
Proposed temporary structures must meet each of the following specific conditions to be eligible for authorization by the
general permit:
(1) All aspects of the structure shall be removed and the site returned to pre-project conditions at the
termination of this general permit.
(2) There shall be no work within any productive shellfish beds.
(3) The proposed project shall not involve the disturbance of any marsh, submerged aquatic vegetation,or
other wetlands including excavation and/or filling of these areas.
(4) The proposed activity shall not involve the disruption of normal navigation and transportation channels and
shall be properly marked to prevent being a hazard to navigation.
(5) The proposed project shall not serve as a habitable place of residence.
(6) There shall be no adverse disturbance of existing dune structures.
(7) Development carried out under this permit shall not exceed one acre in size in accordance with 15A NCAC
2H.1002(1)and 15A NCAC 2H.1003(a)(1).
(8) No sewage disposal system will be allowed without a permit authorized by either the Division of
Environmental Health or the Division of Environmental Management.
