Dear Sir of Madam:
I am one of three owners of the property at 5 Lagoon Drive
Wrightsville Beach, NC. I received a notice from Peter Starek of a:
application for a CAMA permit to construct a dock at 7 Lagoon Drive
Wrightsville Beach, NC. I do not believe the other owners received ,
notice.
I have enclosed an Adjacent Riparian Property Owners Statement
form in which I have indicated objection to the proposal and no waiver o:
the 15 foot setback requirement . Because I have been out of town, I di(
not actually see the notice until yesterday and have not had the
opportunity to speak to the applicants . I believe that I will be able tc
resolve possible issues with the applicants so that we can withdraw am
objection.
The basis for objection to the plan as currently proposed is
that it would not meet the 15 foot riparian line setback established it
the CRC Rules if the riparian line between the applicants property and ou]
property begins at the high water line at the applicants southern cornea
as the high water line existed at the time of the subdivision of the
property as shown on the subdivision map recorded in Map Book 3 at Page 7!
in 1940 . We are concerned that we will lose riparian area if the ripariai
line as proposed by the applicants is used for the northeri boundary of
our lot and the riparian line using the 1940 shore line is used for the
riparian boundary on the south end of our lot . We hope to resolve this b)

of the riparian setback if a different methodology is required by the
regulatory authorities or courts for our southern riparian line.

WAIVER OF RIPARIAN SETBACKS
We,the undersigned, are the owners of Lot12, Block 10,North Shores
Subdivision, Wrightsville Beach with a street address of 5 Lagoon Drive, Wrightsville
Beach,N.C.
We grant a waiver of 5' of the 15' riparian area setback established by the rules
adopted pursuant to the N.C. Coastal Area Management Act(CAMA)to allow the
owners of Sunset Lagoon Condominiums located at Lot 13, Block 10,North Shores
Subdivision,with an address of 7 Lagoon Drive, Wrightsville Beach N.C. to construct
pier modifications to an existing pier in accordance with the plan attached hereto . We
further agree not to contest or appeal any CAMA permit modification application to
construct the modification set forth of the attached plan. This waive expires if the
modification is not completed within three years of the date this waiver is last signed.

Dear Mr. Hall,
The owners of 7 Lagoon Drive and their neighbors the Raney family has agreed on a
mutually beneficial waiver of riparian rights. This agreement will allow the Raney family
to build a dock and the owners of 7 Lagoon drive will extend their dock by a distance of
5 feet and square off the end of the dock. Please see the attached drawing.
This alteration does not in any way encroach on your riparian rights. It also means that
we will no longer need the pole between our docks . We plan to remove this pole at the
time of extending our dock.
If you have any objections to this plan please contact the Division of Coastal
Management with your concerns.
