I, James E. Rice, owner of 807 Johns Orchard Lane, Lot 25, of Wilmington, North Carolina, do agree tc
waive the required riparian setback on the shore line and through the marsh only for the lot owned by
Robert Resh, in order that Mr. Resh may build a dock with a straight run. Mr. Resh owns Lot 26, 811
Johns Orchard Lane, Wilmington, North Carolina. The 15-foot setback will not be waived on the
opposite water end of the dock. This agreement allows Robert Resh to build a straight run from the
shore to the end of the dock of 93 feet, eliminating the need for a dogleg in his walkway.

Installation of a gazebo and dock.
We reserve the right to make a final inspection of the change to make sure it matches the Request you
submitted for Approval. Please follow the plan you submitted or submit an additional Request form if you
cannot follow the original plan.
You must follow all local building codes and setback requirements when making this change. A Building
Permit may be needed. This can be applied for at the County offices.
Our approval here is only based on the aesthetics of your proposed change. This approval should not be
taken as any certification as to the construction worthiness or or structural integrity of the change you
propose. Be aware that you are responsible for contacting the appropriate Utility Companies before digging.
