With a desire to bring back the Carolina Beach of yesteryear, the Applicant, Robby Megerle of Megerle's Magic (a licensed amusement company with over 35 years of experience) is proposing to bring a family-oriented carnival consisting of a series of large mechanical rides, Kid's rides, fun houses and food stands to the historic Carolina Beach Boardwalk beginning in May of 2009. The facilities will remain in place for a period of approximately four months (The Season) and would reserve the right to return in succeeding years with a similar operation. The applicant is currently booked at the following locations this year: March 13-23, 2009 Okeechobee County Fair Okeechobee, FL March 27, 2009 - Suwannee County Fair Live Oak, FL The applicant is fully licensed and inspected by the North Carolina Department of Labor, specifically the Elevator & Amusement Devise Bureau under the Amusement Devise Safety Act and its pertinent administrative rules. The intent of the Act is that amusement devices shall be designed, constructed, assembled (or disassembled), maintained and operated so as to prevent injuries. Inspectors shall inspect each amusement devise at each location to determine if the devise has been soundly constructed and properly erected; modified to comply with any changes in safety requirements prescribed by the manufacturer; and has a log of previous inspections over the past twelve months. In addition, before the ride is open to the public each day, the foreman of each ride goes through every part with a safety checklist to make sure everything is in place and ready to go. The Applicant will provide liability insurance specifically for its operation of no less than one million dollars per occurrence against liability for injury to persons or property arising out of the operation of such devise acceptable to the North Carolina Department of Insurance. Attached are numerous documents (survey and aerial) indicating the affected properties. Also, for review is a proposed site plan representing the anticipated facilities and their proposed locations. The Applicant reserves the right to re-arrange/substitute entities based on unforeseen circumstances with administrative approval from the Planning Director(such as availability, topography, etc.). The applicant proposes to provide up to eighteen (18) grass, parking spaces on Parcel Five at 102 Cape Fear Boulevard, primarily for the use of Megerle employees. These temporary spaces will be designated with wheel stops. A curb cut will be provided from Cape Fear Boulevard. Parking in the CBD has historically been waived due to the availability of public spaces and the Applicant requests that all required parking (except the 18 above) be waived in this instance due to the following criteria: 1. The surrounding Hotel/Motel accommodations already provide adequate parking which will encourage traffic flow of pedestrian, bicycles and taxis. 2. Local residents typically walk or are dropped off at the Boardwalk during the Season. 3. Majority of the Carnival riders buy all-day passes which will overwhelmingly reduce parking needs in the CBD and encourage patronage of all businesses. 4. The majority of the users of these facilities will also visit the surrounding businesses, as well as the beach strand and will have typically already used a designated parking space. Providing additional spaces would be redundant. 5. As in most successful Ocean Resort towns, parking is located at the perimeters (i.e. rental location, residence, Town-owned lots) and pedestrian/alternative modes of transportation are encouraged. The degree of difficulty to parking is inversely proportionate to the amount of time and money the tourist will spend in the CBD. Thl, th, A Fhnf Hours of Operation are proposed to be 10:00 AM until 11:00 PM Sunday through Thursday. The Facility will remain open an additional hour until midnight on Friday and Saturday. If additional hours of operation are anticipated for special occasions, the Town Manager will be approached for a Special Use Permit. Each ride, ticket booth and food stand requires a minimum of one employee to operate, thus a minimum of eighteen employees will be on site at any given time. Based on crowd capacity, up to thirty employees may be utilized. A manager will be on duty at all times and be in contact with the Ticket Booth to handle all situations. The Applicant anticipates local employment opportunities during the season to operate non-technical positions within this operation. The Town of Carolina Beach has previously provided Temporary facilities (Port-O-Lets on flat beds) for special occasions as well as during the season on the FEMA lot. Typically this has consisted of 12 units (including two accessible units) which would give a capacity of 620 (4 male at 75 and 8 female at 40). The Applicant will provide an additional four temporary units (three standard and one accessible) which will increase capacity by 230 (2 male at 75 and 2 female at 40). The Applicant anticipates four power drops for a total load of 1700 amps. Discussions are on-going with Progress Energy to provide adequate power to the locations needed. If power is not adequate, generators can be provided, however it is the desire of the Applicant to use permanent on-site power distribution. Specifications are being formulated for the Food Stands and discussions with the Town for water and sewer are in process. All Food Stands will be licensed and inspected by the New Hanover County Health Department Environmental Health Services (910-798-6667). The following conditions are anticipated: • Loading area is anticipated to be on Raleigh Avenue, similar to the entire Boardwalk area. • Loading will typically take place prior to 10:00 AM • The largest truck anticipated will be the food delivery trucks typically seen serving the Boardwalk area. • The loading period for the vendors should be less than 15 minutes. Most of the vendors anticipated already serve the Boardwalk area. Refuse collection and recycling will be provided on site at the location indicated on the attached drawing. Applicant agrees to strictly abide by the Town Of Carolina Beach Noise Control Ordinance (Sections 10-4 through 10-10). Technical Review Committee Comments March 23, 2009 Comments: Applicant proposes amusement rides on the area of the previously approved Fairfield Inn. Applicant proposes that these amusements would ideally come back for at least 3 years. All rides must be 15 feet from power lines, gravitron may have to be removed if one line cannot be moved. Employees are to be shuttled in from off-site parking facility. Applicant is asking for waiver of 260: 10 per ride with 10 waiting and 40 for concessions, 11 rides x 20 spaces plus 40 for foot = 260 spaces. There will be a generator on-site, but this is required by safety regulations. Applicant is considering using parking on Astor lot, dependant on popularity of location. Food sale is permitted as a full restaurant by New Hanover County Health Department; intent is not to compete with area food sales. Response • We are investigating the re-routing of wires to allow for the rides to be positioned as indicated on the attached plan. Manager: • All rides should be within property lines; hang ten is drawn going over property line; See the revised drawing indicating the same. • Address access control; primarily night, after hour access and how area will be secured; Access to the site will be primarily from the Gazebo and Boardwalk sides. All rides are secured at night and typically additional security is not needed. The rides on Parcel Three and Four may occasionally spill out onto the south end of the Boardwalk at transition times. Insurance policies are addressed in the narrative. • Address concerns about competition with area restaurants The Applicant purposely offers a variety of fast foods not available at area establishments. When food is similar, he tries to offer something unique (i.e. only sells foot-long hot dogs). In addition, he also keeps his prices on the high side, so as not to undercut local businesses. • Provide a dumpster on-site A dumpster will be provided on Woody Hewett. o Address trash impacts on adjacent properties and clean up measures Applicant will offer plentiful trash receptacles on his property. He will work with Town to insure trash collection is maintained. Operations: • Must provide port-o-lets and provide maintenance and pumpout; See narrative for toilet facilities provided. • Address water and sewer hook ups, locations of water/sewer taps, and grease traps; This is on-going with the Town and the Health Department. Police: • Address noise. The Applicant intends to abide by The Town Of Carolina Beach noise ordinance. He will work closely with the Police Department with monitoring the noise levels. See Narrative. Fire: • Address fuel for generators and The Applicant will meet with the Fire Chief to insure all applicable laws are adhered to. • Patrons have to be moved when fireworks are taking place If the 'fire line'crosses the rides, then the Applicant will cooperate with the Fire Department. This issue arises from the multi-year potential and the availability of new rides each year. The desire is to keep it fresh and new year after year. • Parking spaces must be delineated; spaces must have wheel stops to help mark spaces. Curb stops will be installed to designate the parking spaces. • Address separation measures between rides and adjacent properties. All properties are zero lot line requirements and the Applicant reserves the right to use the property accordingly. Security during operating hours is typically handled by the Manager on Duty. The rides lock down tight for the closing hours and are considered Vandel-Proof.
