Under the Coastal Area Manageme ;CAMA), the Coastal Resources Commission (CRC) has established Rules for General and Major Permits for this type of �Iopment that are found in 15A NCAC 07H .1200 and 07H.0208 (b)(6). have notified the Division of Coastal Management of your objections to this proposed development by letter received Augus t010. Your objections to this proposed development are related to the proposed boatlift's proximity to the intersection of th gation channels located to the north of your property. Your objection is also related to the proposed boatlift extending beyo -ter-width of the waterbody and exceeding the established pier head line. DCM Field Staff determined the distance of the �rbody, channel location, water depths, and the established pier head line during a site visit on August 9, 2010. These distar confirmed in the field on September 1, 2010. The Division has reviewed your objections, along with all aspects of this �Iopment proposal for consistency with the aforementioned Rules, which describe the CRC's standards and guidelines for this of development. Our review of the proposed development has found it to be consistent with these Rules. r having given careful consideration to your objections to this proposed development, we have determined that the applicar jest is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have be ;fled. Gregson NCDENR — CAMA 127 Cardinal Drive Extension Wilmington, NC 28405 RE: Permit Notification 120 Windjammer Drive Surf City, North Carolina Dear Sir: Aaaud aeviai aid This letter is to inform your agency that I do not agree to waive the required fifteen (15) foot setback from the shared property line in regards to the proposed project. I cannot agree to the project as currently proposed and request a review of the permit application due on the following: 1. The notification is improper as it lacks sufficient information, dimensions and detail depicting site conditions and the projections of the setback dividing lines and the channel associated for the dividing line. 2. The proposed construction projecting outside of the existing dock may extend more than one - quarter of the distance of the finger channel and beyond the established pier head line, in addition to violating local deed restrictions. 3. The construction in the location as proposed encroaches into either, or both of the navigation channels at or near their connection. We request that at a minimum, due to the proximity to the intersection of the navigation channels, the construction be shifted a greater distance from the main channel. I thank you in advance for your assistance in this matter, and I request a written response regarding the determination of the permit review, including the issues listed above.
