Activities required for the construction, maintenance, repair, and removal of utility lines and associated facilities in waters of the United States, provided the activity does not result in the loss of greater than 1/2 acre of waters of the United States. Utility lines: This NWP authorizes the construction, maintenance, or repair of utility lines, including outfall and intake structures, and the associated excavation, backfill, or bedding for the utility lines, in all waters of the United States, provided there is no change in pre - construction contours. A "utility line" is defined as any pipe or pipeline for the transportation of any gaseous, liquid, liquescent, or slurry substance, for any purpose, and any cable, line, or wire for the transmission for any purpose of electrical energy, telephone, and telegraph messages, and radio and television communication. The term "utility line" does not include activities that drain a water of the United States, such as drainage tile or french drains, but it does apply to pipes conveying drainage from another area. Material resulting from trench excavation may be temporarily sidecast into waters of the United States for no more than three months, provided the material is not placed in such a manner that it is dispersed by currents or other forces. The district engineer may extend the period of temporary side casting for no more than a total of 180 days, where appropriate. In wetlands, the top 6 to 12 inches of the trench should normally be backfilled with topsoil from the trench. The trench cannot be constructed or backfilled in such a manner as to drain waters of the United States (e.g., backfilling with extensive gravel layers, creating a french drain effect). Any exposed slopes and stream banks must be stabilized immediately upon completion of the utility line crossing of each waterbody. Utility line substations: This NWP authorizes the construction, maintenance, or expansion of substation facilities associated with a power line or utility line in non -tidal waters of the United States, provided the activity, in combination with all other activities included in one single and complete project, does not result in the loss of greater than 1/2 acre of waters of the United States. This NWP does not authorize discharges into non -tidal wetlands adjacent to tidal waters of the United States to construct, maintain, or expand substation facilities. This .3roject consists of the replacement of approximately 8,400 LF of wastewater line located between Manhole #6 and I-40. Sections of the project area run parallel to Smith Creek and are located within a :;AMA Area of Environmental Concern. Additionally, a small amount of coastal wetlands is located within the easement. Wetlands to be impacted during the project will be restored back to grade and >eeded with a wetland seed mix. Based on previous discussions with Holley Snider, we believe that the .)roposed work qualifies for a Maintenance and Repair Exemption. Culvert Installation Placement of culverts and other structures in waters, streams, and wetlands must be placed below the elevation of the streambed by one (1) foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water and aquatic life. Design and placement of culverts and other structures including temporary erosion control measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide evidence that the equilibrium shall be maintained if requested in writing by DWQ. Culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re -installed correctly. 5. Work In The Dry All work in or adjacent to stream waters shall be conducted in a dry work area. Construction Stormwater Permit NCGO 10000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES General stormwater permit (NCG010000) administered by DWQ is automatically issued to the project. PROJECT SUMMARY & RESTORATION PLAN Cape Fear Public Utility Authority Ogden Interceptor Wastewater Line New Hanover County, NC RECEI-SIED APR 2 1 2010 DCK4 W10VIINGTON; The Ogden Interceptor consists of an existing 40'-wide utility easement which contains a 36" diamete pipe that transports wastewater underground. It is located between the Kerr Avenue Pump Station an( I-40 and delivers wastewater to the Northside Wastewater Treatment Plant. Easements are maintaine< by the Cape Fear Public Utility Authority per collection system permit WQCS00012. Due to recen failures in the line, it has been determined that the entire 9,000 LF of pipeline will need to be replaced Approximately 8.3 total acres are estimated to be disturbed during construction. Disturbance will b4 limited to a 40' wide corridor along the pipeline route. The project has been divided into two phases Phase 1 will consist of replacing the southernmost 600 LF of pipe (from Kerr Ave. PS to Manhole #6 and will occur between April — June. Phase 2 will consist of replacing the remaining 8,400 LF of pipe and will occur between June — November. Phase 1 is considered to be the highest priority because o leaks in the line at this location and its proximity to tidal waters. Several failures have recently occurred within the project area, which requires the prompt replacemen of the line. The repair of one of these leaks in September of 2009 caused the Authority to place some temporary fill in a section of wetlands near the intersection of Kerr Avenue and Grathwol Drive. Th4 fill was needed to allow access to equipment in order to perform emergency repair work to the pipe Based on aerial maps of the site and observations made by the contractor during construction, i appears that approximately 0.20 acre of 404 wetlands was disturbed.. A bypass pipe now runs along sections of the corridor. The existing easement is currently kept in a mowed condition and much of i contains 404 wetlands. Additionally, this easement runs parallel to Smith Creek, which is classified & inland waters and public trust waters. Sections of the easement are located within 30' from norma high water and fall within the NC Division of Coastal Management's Area of Environmental Concern rubber tire loaders, backhoes, off road dump truck and rock boxes. During construction, the contracto will excavate the top layer of organic soil and set it aside for reuse. The old pipe and any existin; gravel will be removed from the trench and disposed of off site in a lined landfill. New beddin; material will be placed in the excavated trench and backfill material placed and compacted. The top c piping is between 8 and 12 feet below ground surface. In certain locations along the pipelin alignment, trench sheeting will be required to install the new pipeline. The lower portions c this sheeting adjacent to the pipe will remain in place to protect the subgrade soils and to confine th pipe bedding. The sheeting will be cut above the top of pipe allowing the protective portions of th sheeting to remain and the upper portions removed allowing unobstructed surface soils. Then the to layer of soil that was first excavated will be placed back in the trench as required. Additionally, anti seep collars will be used. There is a small creek (2' wide) crossing the easement between the Jamey Court and Noland 1 Grathwol access points. The contractor will need to temporarily block flow and provide bypa&q pumping during the pipeline crossing of the creek. Following completion, creek flow will b reestablished and the channel will be stabilized. No rip rap will be used. Vehicular and construction equipment access to the easement will be limited to the followin locations: Robin Dale Court, Noland & Grathwol Drives, Progress Energy ROW, Thornin Court; Ea Drive & Spring Valley Road; Access near I-40. It was determined at a site meeting with regulator officials that access points at Cheryl Court and Jamey Court would not be used because of wl conditions and/or steep slopes. The contractor will use the easement to reach these sections. To reduc compaction, logging mats will be used in wetter sections of the corridor and where wetlands exten across the entire easement, as shown on the attached maps. The contractor may choose the method c accessibility within the easement in other locations. All fill and/or structures will be removed froi wetland areas once the construction in that segment is complete. Silt fencing is shown on the drawing at numerous locations for sheet flow protection and is to be placed primarily down -slope of tl• proposed construction. Details are shown on the construction plans for correct installation of a Surface soils along the entire alignment will be salvaged during excavation and trenching. These soil will be replaced in the upper portions of the trench during backfilling and easement returned to pre construction elevations and conditions. Ground elevations along the easement will be taken prior t, construction in order to reestablish grades once the work is complete. After this work is complete, th area will be seeded with a wetlands seed mixture. The 40' wide permanent easement will continue t, be maintained by periodic mowing. Additionally, approximately 0.2 acre of unauthorized wetland fill located near Manholes #5-7 will b removed. Most of this fill material came from the adjacent stormwater berm and will be returned t this upland location. This area will be seeded with a wetlands seed mixture as well. FOR HAND DELIVERY March 22, 2010 Rick Shiver, Supervisor Wilmington Regional Office Surface Water Protection Section Division of Water Quality Subject: Response to DENR DWQ's Additional Information Request Permit No. WQCS00012 CFPUA Collection System New Hanover County Dear Mr. Shiver: The Division of Water Quality has requested additional information regarding pipe failures on the Ogden Interceptor. HOBAS (CCFRPM) Pipes are centrifugally cast, glass -fiber -reinforced, polymer mortar. Approximately 8,700 feet of HOBAS pipe was placed between College Road and Kerr Avenue along Smith Creek in 1998. A 220 foot section of 30-inch diameter pipe is on the Northern end of the interceptor. This section connects to an 8,226 foot section of 36-inch diameter pipe that extends to Kerr Avenue. A 246 foot section of 48-inch pipe completes the interceptor at pump station #89. We have experienced line collapses on the 36-inch sections of the interceptor, and we have taken actions to repair these collapses while minimizing the impact to the environment. We understand the environmental sensitivity of the area shared by the Ogden Interceptor, and we continue to strive to work as good stewards of the environment. The line collapse that occurred in March of 2008 was near the Kerr Avenue Pump Station between Robin Dale Court and Jamey Court. New Hanover County employees noticed high flows at the Kerr Avenue Response to DENR DWQ's Additional Information Request Division of Water Quality March 22, 2010 Page 2 collapse was 36-inch HOBAS pipe. The other pipe failures in September 2009, February 2010 and March 2010 were repaired using 36-inch ductile iron pipe with a sewer coating because of availability, the short lead time needed to acquire the product, and the immediate need for the repair. Approximately 500 feet of ductile iron pipe was used to repair these failures. We were concerned about the integrity of the entire line after the Sept 2009 collapse and at that point we began investigating options to determine the integrity of the line. At that time, Southeast Pipe and Repair was under contract performing large diameter line cleaning. We requested to extend the contract with them to complete the evaluation. They were not able to meet our requirements for laser and sonar profiling. We received a quote from Red Zone Robotics and Compliance Envirosystems to perform specialized testing using laser and sonar profiling technology in a condition assessment of the entire length of the Ogden Interceptor. Compliance EnviroSystems provided a quote for $92,000 to complete the assessment. They were given a notice to proceed on January 26, 2010. They were initially scheduled to begin the assessment in February, but weather complications prohibited them from beginning the evaluation until March 2, 2010. They are contracted to provide us with high resolution CCTV video, a high resolution video viewer, a laser profiler, sonar, flat graph, measurements in excel and CAD formats as deliverables for the project. The initial findings of the condition assessment show the entire line needs to be replaced. Our plans include setting up bypass pumping for the length of the interceptor and replacing the entire length using ductile iron pipe with a sewer coating. The SSO that occurred at Jamey Court during bypass pumping after the February 24, 2010 collapse was caused when the bypass pump was clogged with flushable wipes and rags. We will continue to educate our customers to reduce or eliminate these items from our collections system. The March 4, 2010 line break occurred when the contractor removing the collapsed pipe struck the emergency bypass line with the excavator. No sewage was released to area waters as it was contained within the excavation area and pumped back into the collections system. Compliance EnviroSystems has begun inspection of the Ogden Interceptor and discussed its preliminary findings with CFPUA on March 9, 2010. Based on their initial findings the line has been determined to be in an imminently failing condition. The Board approved our request to declare the repairs a Special Emergency under NCGS 143-129(e) (2) during the March 2010 meeting which allows flexibility in the procurement of materials and award of contracts. Riparian Area Protection (Buffer) Rule Activities located in the protected 50-foot wide riparian areas (whether jurisdictional wetlands or not), within the Neuse, Tar -Pamlico, Catawba, Randleman, and Jordan (or any other basin with buffer rules), shall be limited to "uses" identified within and constructed in accordance with 15A NCAC 2B .0233, .0259, .0250, .0243, and .0267, and shall be located, designed, constructed, and maintained to have minimal disturbance to protect water quality to the maximum extent practicable through the use of best management practices. All buffer rule requirements, including diffuse flow requirements, must be met. 8. Water Supply Watershed Buffers The 30-foot wide vegetative buffer (low -density development) or the 100-foot wide (high - density development) must be maintained adjacent to all perennial waters except for allowances as provided in the Water Supply Watershed Protection Rules [15A NCAC 2B .0212 through .0215]. 9. Any rip rap required for normal pipe burial and stabilization shall be buried such that the original stream elevation is restored and maintained. 10. Compensatory Mitigation In accordance with 15A NCAC 2H .0506 (h), compensatory mitigation may be required for losses of 150 linear feet or more of streams and/or one (1) acre or more of wetlands. For linear, public transportation projects, impacts equal to or exceeding 150 linear feet per stream shall require mitigation. Compensatory stream mitigation shall be required at a 1:1 ratio for all perennial and intermittent stream impacts. Buffer mitigation may be required for any project with Buffer Rules in effect at the time of application for buffer impacts resulting from activities classified as "Allowable with Mitigation" within the "Table of Uses" section of the Buffer Rules or require a variance under the Buffer Rules. A determination of buffer, wetland and stream mitigation requirements shall be made by the Division for any application for this Certification. Design and monitoring protocols shall follow the US Army Corps of Engineers Wilmington District Stream Mitigation Guidelines (April 2003), or its subsequent updates. The construction corridor (including access roads and stockpiling of materials) is limited to 40 feet (12.2 meters) in width in wetlands and across stream channels and must be minimized to the maximum extent practicable. 20. Permanent, maintained access corridors shall be restricted to the minimum width practicable and shall not exceed 15 feet in width except at manhole locations. A 15-foot by 15-foot perpendicular vehicle turnaround must be spaced at least 500 feet (152.4 meters) apart. 21. An anti -seep collar shall be placed at the downstream (utility line gradient) wetland boundary and every 150 feet (45.7 meters) up the gradient until the utility exits the wetland for buried utility lines. Anti -seep collars may be constructed with class B concrete, compacted clay, PVC pipe, or metal collars. Wetland crossings that are directionally drilled, and perpendicular wetland crossings that are open cut and less than 150 feet (45.7 meters) long do not require anti -seep collars. The compacted clay shall have a specific infiltration of 1 X 10- 5 cm/sec or less. A section and plan view diagram is attached for the anti -seep collars. The following specifications shall apply to class B concrete: a) Minimum cement content, sacks per cubic yard with rounded course aggregate 5.0 b) Minimum cement content, sacks per cubic yard with angular course aggregate 5.5 c) Maximum water -cement ratio gallons per sack 6.8 d) Slump range 2" to 4" e) Minimum strength - 28 day psi 2,500 22. The applicant shall have a specific plan for restoring wetland contours. Any excess material will be removed to a high ground disposal area. 23. If an environmental document is required under NEPA or SEPA, then this General Certification is not valid until a Finding of No Significant Impact (FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse. 24. In the twenty (20) coastal counties, the appropriate DWQ Regional Office must be contacted to determine if Coastal Stormwater Regulations will be required. . 25. This General Certification does not relieve the applicant of the responsibility to obtain all other required Federal, State or local approvals. 26.
