that parcel of land lying and being in the Town of Wrightsville
Beach, County of New Hanover, State of North Carolina, and
more particularly described as follows:
ALL of Lot 14 of the Mrs. E. I. Bear property
on Wrightsville Beach according to the map

with the land lying between the western line

AND WHEREAS, the parties of the first part own the
southern one-half (1/2) of the pier which extends into Banks
Channel and which is presently located at the extension of the
northern line of Lot 14 described above if the same were
extended westwardly to the mean high water mark of Banks
Channel;
AND WHEREAS, said one-half (1/2) of said pier presently
owned by the parties of the first part contains six slips, of
which the parties of the first part desire to retain a one-third
(1/3) undivided interest in said southern one-half of the pier

part; and BOYD K. BRESNAHAN, party of the second part, of 710
Waynick Boulevard, Wrightsville Beach, North Carolina, 28480.
W I T N E S S E T H:
WIIEREAS, the parties of the first part now own all of
that parcel of land lying and being in the Town of Wrightsville
Beach, County of New Hanover, State of North Carolina, described
as Tract 1 hereinafter;
AND WHEREAS, the parties of first part own an undivided
two-thirds (2/3) interest in and to that parcel of land lying and
being in the Town of Wrightsville Beach, County of New Hanover,
State of North Carolina, and described as Tract 2 hereinafter;
AND WHEREAS, the parties of the first part own an
undivided two-thirds (2/3) interest in the southern one-half
(112) of the pier which extends into Banks Channel from the land
described as Tract 2 hereinafter;
AND WHEREAS, said southern one-half (1/2) of said pier
presently consists of six (6) boat slips, of which by agreement
recorded in Book 1191 at Page 1844 of the Nev Hanover County
Registry, the parties of the first part have the exclusive right
to use the first boat slip closest -to the eastern shore of Banks
Channel, and the fourth, fifth and sixth boat slips from the
eastern shore of Banks Channel;
AND WHEREAS, said parties of the first part, desire to
convey by this instrument to the party of the second part all of
their rights and interests in and to Tract 1 described
hereinafter; a one-third (1/3) undivided interest in and to Tract
2 described hereinafter, together with an undivided one-third
(1/3) interest in the southern one-half (1/2) of the pier
extending from Tract 2 described hereinafter into Banks Channel
of which pier, the party of the second part shall be restricted
and limited to the use of the fifth and sixth boat slips
Westernmost from the eastern shore of Banks Channel;
NOW, THEREFORE, said parties of the first part, in
consideration of the sum of TEN ($10.00) DOLLARS and other good
and valuable considerations to them in hand paid by said party of
the second part, the receipt of which is hereby acknowledged,
have given, granted, bargained, and sold, and by these presents
do give, grant, bargain, sell and convey unto the said party of
the second part, his heirs and assigns, in fee simple, all that
certain tract, parcel or lot of land, located in the Town of
Wrightsville Beach, County of New Hanover, State of North
Carolina, bounded and described as follows, to wit:
