HomeMy WebLinkAbout57371D - Bald RECEIVED AUF3 0 2111 DCM WILMINGTON, NC NCDENR North Carolina Department of Environment and Natural Resources Beverly Eaves Perdue Dee Freeman Governor Secretary ACTIVATION OF CAMA EMERGENCY GENERAL PERMIT 7H.2500 IN CAMA COUNTIES AFFECTED BY HURRICANE IRENE I, Dee Freeman, Secretary pf Environment and Natural Resources, hereby find that initial reports of damage from Hurricane Irene affecting the State August 26-28, 2011 indicate that it would be appropriate to activate the provisions of CAMA General Permit 7H.2500 in the counties where storm damage has been observed. Upon recommendation of the Director of the Division of Coastal Management, CAMA General Permit 7H.2500 is activated subject to the following conditions: 1. CAMA Emergency General Permit 7H.2500 authorizes the rebuilding of structures on the estuarine shoreline and in estuarine or public trust waters; maintenance dredging of existing boat basins, canals, navigation channels and ditches; and dune reconstruction. To be authorized under CAMA Emergency General Permit 7H.2500, the activity must comply with the terms and conditions set out in the general permit. All other existing CAMA general permits and exemptions also continue in effect. 2. Activation of CAMA Emergency General Permit 7H.2500 applies only to hurricane recovery activities in the following counties: Beaufort, Bertie, Brunswick, Camden, Carteret, Chowan, Craven, Currituck, Dare, Gates, Hertford, Hyde, Pamlico, Onslow, Pasquotank, Perquimans, Pender, New Hanover, Tyrrell and Washington Counties; 3. Under Section .2502(f), authorizations under this General Permit may not be issued more than twelve (12) months following the activation of the General Permit; 4. Under Section .2503, the two hundred dollar ($200) permit fee is waived for authorizations issued under Emergency General Pen -nit 7H.2500. 5. All remaining provisions of CAMA Emergency General Permit 7H.2500 as set out in 71-1.2501, .2504 and .2505 shall be in effect for 365 calendar days from the date of activation indicated below and shall apply to all activities authorized under the General Permit. Biologists with the NC Wildlife Resources Commission (NCWRC) have reviewed this request with regard to potential impacts to fish and wildlife resources. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 1I3A- 128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant is requesting permission to push sand to reinforce the primary, frontal dune system as a result recent coastal storm activity from Hurricane Irene. Due.to increases in erosion along the entire coast of North Carolina, the Secretary of the Department of Environment and Natural Resources has enacted GP2500 to allow for emergency sand pushing to reinforce lost frontal dune systems as a result of the recent hurricane. Bald Head Island (BHI) is requesting to push sand from lot 230 along Station House Way north to lot 29 of East Beach Dr. Sand would be used to create 6-8' high dunes. I wanted to give you a heads up on what the Division has decided in regards to the u !mergency GP .2500 for the East Beach area on Bald Head Island. Chris McCall has provided us with some good mation of what was done and what existed before Hurricane Irene hit the coast. His following statement to DC "as the CAMA LPO, from my visual knowledge having been out on East Beach pre -storm it is my belief that the ture that was out there was intact w/ stable vegetation as it was re -constructed and tied back into the original )ack in'08" along with the two attached photos are sufficient documentation to implement the use of GP .250( quested in the GIS map, the Division is comfortable allowing the frontal dune to be reconstructed along 18001 :)f shoreline along East Beach. The height of the'08 sand push in the photos appears to be between 8' and 10' ettled and established at a height around 8' as indicated in the first attached photo where the dune plantings f i place. Therefore, the Division will be writing the GP for the reconstruction of the frontal dune to a height of f ,ion, as we discussed, it is difficult to define the MHW/MLW after these storms based on field indicators.
