Re: Right of Entry to the Coastal Earth Works, Inc. for State Owned Property in Pender County
Dear Mr. Watters:
Please consider this letter authorization for Coastal Earthworks, Inc. to go upon State lands assigned to the
Department of Administration located in Pender County and further identified on the attached site sketch for the purpose of
depositing dredged spoil material under the following limiting conditions upon the subject premises. By acceptance of this
right of entry, evidenced by the performance of work on the property, Coastal Earthworks, Inc. indemnifies and holds
harmless the State of North Carolina for injury, loss or damage arising out of the actions of Coastal Earthworks, Inc., its
agents or contractors performing work on the premises. Coastal Earthworks, Inc. is authorized to enter upon the subject
property between the present date and April 1, 2012 and then between September 1, 2012 and April 1, 2013 for the sole
purpose of depositing up to but not exceeding 300 cubic yards of dredged spoil material upon the State land where specified
on the attached site sketch and as further directed by the prerequisite C.A.MA. permit.
The State shall have the right to terminate this right for any reason at its sole and absolute discretion by giving
Coastal Earthworks, Inc. thirty (30) days prior written notice. This right of entry expires April 1, 2013, unless terminated
earlier by either party. The State shall also have the right to immediately terminate this right of entry without prior written
approval in the event that Coastal Earthworks, Inc. violates the terms of this right of entry. This right of entry is granted
subject to all necessary Federal, State and local permits or approvals required for the proposed project.

6) Resulting spoil material hauled to applicant's high ground oroperty must
be leveled and smoothed to,conform to surrounding area and be provided with
ground cover sufficient to restrain erosion.
7) The activity nest be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction -related
discharge (increases of 25 KTUs or less are not considered significant).
8) Construction of the authorized project or its planned use must in no way
block existing channels or impede the use of adjacent marina facilities.
