1. Parties and Date: This Contract is made and entered into on 03-05-12, by The
Moorings HOA whose address is 352 Causeway Drive hereafter referred to as "Owner",
and Connaway Marine Construction,. whose address is 1541 Kings :Landing Rd.,
hereafter referred to as " Contractor".
2. Consideration: In consideration of the mutual premises and covenants contained in
this contract, the parties agree to abide by all of the terms in this contract.
3. Work to be performed: Removal of walkway in a manner to save any and all
materials that could be reused for the replacement of the walkway after completion of
anchors and new concrete cap. Material will be then stored on site in a staging area for
construction agreed to by the owners. After walkway has been removed, we expect to see
The old bulkhead and where the old tie back rods have failed.
Removal of the old concrete cap at this time will be necessary to free up the top of
the concrete sheets. We will be able to utilize this material for backfill after anchors and
new cap are installed and wall has been straightened. It's obvious to both engineers that
visited the sight, the cap has failed therefore needing replacement. Normally, this is where
the old bulkhead would have had a tie back system attached supporting the sheet pile.
Excavation of materials behind the concrete wall including any of the old bulkhead
pressure. We will install anew 8x8x16' or 8xl2xl2' whaler system that will be put
against the existing concrete with the new tieback cable or rod that will attach to the
outside of the new whaler. The spacing and depth of the new anchors will be determined
by the soil conditions and amount of tonnage bearing to support the concrete wall to be
determined by the engineer. Engineering will be provided by Jeff Troutman of Crisner,
Troutman and Tanner Engineering Firm. I've also met on site with David Turkletaub
who is also a structural engineer who was under the impression that the wall is a complete
failure and needs to be replaced.
I have used the Crisner, Troutman Firm for numerous projects in the past, and am
confident that their solution will be appropriate in this situation. The engineering fees for
their services will constitute a separate contract with the HOA as well as the installation
of the irrigation, plumbing, and all electrical wiring. Connaway Marine will be abler to
remove these services but the installation should be done by whomever is currently
keeping these in service. The recommendations by Crisner, Troutman will be included
and incorporated as part of this contract and installation will proceed as suggested by the
engineering firm.
Once pressure is applied to the whalers and the installation of the anchors is
complete, we will record our tonnage values and photograph them for your records and
the engineering firm. After the wall is straightened to the best of our ability and the new
whaler system is installed we will form and pour a new concrete cap as designed by
Troutman Engineering. If the engineering firm feels that it is necessary to add tiebacks to
the new cap these will be installed at this time. Once the new cap has been poured in
place, we will give it a few days to cure, then mirafi fabric which is a roadbed cloth that is
applied between the concrete and backfill. Starting with the concrete and large stone, we
will begin installation of backfill and compact fill dirt until the proper elevation is
