Davis vemor Director June 15, 2012 na Burch B-Var Road ply, INC 28462 r Mrs. Bruch: Dee Freer Secre letter is in response to your correspondence, which was received in this office on June 11, 2012, regard concerns about the proposed development by Phillip Farlow at 993 B-Var Road adjacent to the Atlantic icoastal Waterway, in Supply, Brunswick County. The project consists of the installation of a boatlift an ting platform. The applicant provided this office with a copy of a survey performed by Gary Gurganus icting the location of the riparian corridors, the 15 foot riparian setback lines and the location of the ling pier. Based on your letter and the documentation provided the proposed project has been !rmined to comply with local regulations and the Rules of the Coastal Resources Commission Section 7H 10 General Permit for Construction of Piers and Docking Facilities, and as such, a permit has been issued iorize the development. My neighbor's contractor/agent, Mr. Will Richardson, requested the waiver late Wednesday, May 301h. He stated (orally) there would be no more than a 12' encroachment and that there was nothing I could do to prevent the encroachment. According to Mr. Richardson, if I refused to sign the waiver, it would only delay the process for 6 months or so and make it more burdensome for my new neighbors. There were no written specifications on the waiver form I signed and no copy provided. The waiver listed a drawing, but that was not shown to me until Monday June 4th after a second request asking for it specifically. Upon later investigation, I learned that the process as it was explained to me by Mr. Richardson was incorrect. I subsequently asked for a copy of the waiver Sunday, June 3'd, which Mr. Richardson supplied. As it lacked the pertinent information regarding encroachment specifications, I then requested the "drawing" to which the waiver referred. The drawing lists a ramp of 3' x 16' and floating dock of 12' x 16' as well, extending toward my existing dock. The drawing appears to be incomplete and lack many detailed aspects of the construction project. As the process was misrepresented and the specifications of encroachment misrepresented, I would like to revoke my agreement to waive my rights for the Farlow's (neighbors at 993 B-Var Rd.) new dock construction. Please feel free to contact me for any further information or if there is anything else I need to do to comply with a retraction of this waiver. Thank you for your assistance with this matter. I was trying in good faith to be a good neighbor and build a lasting, positive friendship as a property owner. I appreciate your understanding and advice. As per your instructions, I am attaching a copy of the new waiver, letter of recension to Mr. Richardson, and the former waiver/drawing provided by Mr. Richardson.
