In conjunction with this previously permitted project Brunswick County is also expanding part of their Northeast Brunswick Regional Wastewater Transmission Facilities. The expansion of the sewer system will include the installation of an 18-inch sewer force main under Sturgeon Creek by directional drill. The force main will be installed in a Brunswick County Utility Easement next to the Navassa Road Bridge in Leland and Navassa. The wetlands on the site were delineated by Matt Smith with Environmental Services Inc. and field verified by USACE on May 5, 2012. The force main has been designed to avoid all impacts to wetlands by being directionally drilled under the wetlands and using silt fence to control construction runoff in areas next to the wetlands. The proposed force main will not changE any existing contours or ground elevations within the CAMA AEC or 100 year flood plain. Wastewater Transmission Upgrades Project 1D: BRUNS-2013-004 County: Brunswick 1. This plan approval shall expire three (3) years following the date of approval, if no land disturbing activity has been undertaken, as is required by Title 15A NCAC 4B .0129. 2. The developer is responsible for the control of sediment on -site. If the approved erosion and sedimentation control measures prove insufficient, the developer must take those additional steps necessary to stop sediment from leaving this site. Each sediment storage device must be inspected after each storm event. Maintenance and/or clean out is necessary anytime the device is at 50% capacity. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regarded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches. 4. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include agencies such as the Division of Water Quality6s stormwater regulations, their enforcement requirements within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers6 jurisdiction of Section 404 of the Clean Water Act, the Division of Coastal Management6s CAMA requirements, the Division of Solid Waste Managements landfill regulations, the Environmental Protection Agency and/or The U.S. Army Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities ordinances, or others that may be required. This approval cannot supersede any other permit or approval; however, in the case of a Cease and Desist Order from the Corps of Engineers, that Order would only apply to wetland areas. Any soil waste that leaves this site can be transported to a permitted mine or separately permitted construction sites without additional permits. Disposal at any other location would have to be included as a permit revision for this approval. 7. This permit allows for a land disturbance, as called for on the application plan, not to exceed five (5) acres. Exceeding that acreage will be a violation of this permit and would require a revised plan and additional application fee. As proposed, the land disturbance width of the utility line should not exceed fifteen (15) feet. 8. As a condition of the provided NPDES General Stormwater Pemit, groundcover stabilization must meet specific time frames. Slopes (including cuts, fills, and ditch banks) that are steeper than 3 horizontal to 1 vertical left exposed will, within seven (7) calendar days after completion of any phase of grading, be provided with groundcover. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed and shall be actively maintained. c. An operation and maintenance plan including pump station inspection frequency, preventative maintenance schedule, spore parts inventory, and overflow response shall be developed and implemented. d. Pump stations that are not connected to a telemetry system (i.e. remote alarm system) shall be inspected by the Permittee or its representative every day (i.e. 365 days per year). Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High -priority sewer lines shall be inspected by the Permittee or its representative at least once per every six-month period of time. A general observation of the entire sewer system shall be conducted by the Permittee or its representative at least once per year. g. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a) in addition to any applicable press release or public notice required by North Carolina General Statute § 143-215.1 C. h. A Grease Control Plan shall be implemented as follows: 1. For publicly owned collection systems, the Program shall include at least bi-annual distribution of educational materials for both commercial and residential users and the legal meons to require grease interceptors for new construction and retrofit, it necessary, of grease interceptors at existing establishments. The Program shall also include legal means for inspections of the grease interceptors, enforcement for violators, and the legal means to control grease entering the system from other public or private satellite sewer systems. 2. For privately owned collection systems, the Program shall include at least bi-annual distribution of educational materials to all users of the collection system by the Permittee or its representative. 3. Grease education materials shall be distributed more often than required in Parts 1 or 2 of this sub-oaroaraph if necessary to prevent arease-related sanitary sewer overflows. S. Per 15A NCAC 2T .01 16, upon completion of construction and prior to operation of these permitted facilities, the completed Engineering Certification form attached to this permit shall be submitted with the required supporting documents (as -built or recording drawings and pump station designs, if applicable) to the address provided on the form. A complete certification is one where the form is fully executed and the supporting documents are provided as applicable. Any wastewater flow made tributary to the wastewater collection system extension prior to completion of this Engineer's Certification shall be considered a violation of the permit and shall subject the Permittee to appropriate enforcement actions. If the permit is Issued to a private entity with an Operational Agreement, then a copy of the Articles of Incorporation, Declarations/Covenents/Restrictions, and Bylaws that have been appropriately filed with the applicable County's Register of Deeds office shall be submitted with the certification. A complete certification is one where the form is fully executed and the supporting documents are provided as applicable. Supporting documentation shall include the following: a. One copy of the project construction record drawings (plan & profile views of sewer lines & force mains) of the wastewater collection system extension. Record drawings are defined as the design drawings that are marked up or annotated with after construction information and show required buffers, separation distances, material changes, etc. b. One copy of the supporting pump station design calculations (selected pumps, system curve, operating point, buoyancy calculations, available storage if portable generator(s) or storage greater than longest past three year outage reliability option selected) for any pump stations permitted as part of this project. C. Changes to the project that do not result in non-compliance with this permit, regulations, or the Minimum Design Criteria should be clearly identified on the record drawings, on the certification in the space provided, or in written summary form. Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting in non-compliance with this permit (including pipe length increases of 10% or greater, increased flow, pump station design capacity design increases of 5% or greater, and increases in the number/type of connections), regulations, or the Minimum Design Criteria. Requested modifications or variances to the Minimum Design Criteria will be reviewed on a case -by -case basis and each on its own merit. Please note that variances to the Minimum Design Criteria should be requested and approved during the permitting process prior to construction. After -construction requests are discouraged by the Division and may not be approved, thus requiring replacement or repair prior to certification & activation. Gravity sewers installed greater than ten percent below the minimum required slope per the Division's Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until corrected. If there is an unforeseen obstacle in the field where all viable solutions have been examined, a slope variance can be requested from the Division with firm supporting documentation. This shall be done through a permit modification with fee. Such variance requests will be evaluated on a case -by -case basis. Resolution of such request shall be evident prior to completing and submitting the construction certification. A copy of the construction record drawings and pump station designs, if applicable, shall be maintained on file by the Permittee for the life of the wastewater collection facilities. 10. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 11. The abandonment of any existing wastewater facilities including septic systems being replaced by new sewer infrastructure shall be done in accordance with the applicable agency having compliance oversight on such facilities. 12. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 13. NON-COMPLIANCE NOTIFICATION: The Permittee shall verbally report to a Division of Water Quality staff member at the Wilmington Regional Office, telephone number (910) 796-7215, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: a. Any failure, due to known or unknown reasons, that renders the system incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.: or b. Any failure of a pumping station or sewer line resulting in a by-pass of any wastewater directly to receiving waters from the station or sewer line. Voice mail messages or faxed information is permissible, but shall NOT be considered as the initial verbal report. Overflows and spills occurring outside normal business hours may also be reported to the Division of Emergency Management at telephone number (800) 858-0368 or (919) 733-3300. Persons reporting any of the above occurrences shall file a spill report by completing Part I of Form CS-SSO (or the most current Division approved form), within five days following first knowledge of the occurrence. The wastewater collection system will also be expanded: Phase 1 Phase 2 • 3,300 linear feet (l.f.) of 12-inch force main • 1,2001_f. of 12-inch force main • 3,10011 of 18-inch force main • 20011. of 24-inch force main • 1,50011 of 12-inch force main • 2,70011 of 18-inch force main These additions to the collection system will require upgrades to the Clairmont, Commerce, and Lincoln School pump stations. Construction at the WWTP to allow for the Phase 1 expansion will include: influent screen; equalization pump station and tank; aeration basin; clarifier, effluent filter, UV disinfection system; effluent pump replacement; ATAD residuals treatment; and new 24-inch effluent discharge piping. Construction at the WWTP to allow for the Phase 2 expansion will include these new process components: influent headworks, equalization storage tank; aeration basin; clarifier, effluent filter; UV disinfection; effluent pump station; and residuals treatment. Four alternatives were considered for wastewater treatment and disposal: 1) no action; 2) connection to an existing WWTP; 3) expansion of the Northeast Brunswick Regional WWTP with effluent disposal by spray irrigation; and 4) expansion of the Northeast Brunswick Regional WWTP with effluent disposal by surface water discharge. Option 4 is the preferred alternative. Direct impacts have been avoided and minimized to the extent practicable during project planning and design. Noise levels will temporarily increase in the immediate vicinity of construction locations; however, this impact will be temporary and occur only between the hours of 8AM and 6PM Monday through Friday. Nuisance noise levels are not expected to increase or change adversely when the new expansion comes on- line. Topography and soils will be directly impacted by grading activities; however, these alterations will not result in permanent adverse impacts to the topography or soil. This project will not impact local flood elevations. While immediate local air quality at the construction sites will be degraded by stirred dust, limited open burning of cleared vegetation, and emissions from machinery, the expanded WWTP and wastewater transmission infrastructure are not anticipated to significantly impact local air quality. Direct impacts to streams and wetland areas from installation of the effluent discharge line and force mains will be temporary as affected areas will be returned to their original slope and contour following construction. A total of 11.25 forested acres will be cleared to allow the construction of Phases 1 and 2 of the WWTP expansion, and an approximately 0.60 acres of forested area will be cleared for force main installation. Proper erosion and sedimentation practices will be followed during construction to protect local water quality as well as aquatic habitat and wildlife. Installation of the new effluent discharge line cannot occur between February 1 and June 30 to avoid impacting the shortnose sturgeon. There will not be any significant direct negative impacts on existing land uses; prime or unique farmlands; groundwater, public lands, and scenic, recreational and State natural areas; known archaeology cal or historical resources: shellfish or fish and their Based on the findings of the EA, the impact avoidance/mitigation measures contained therein, and reviewed by governmental agencies, the Division of Water Quality has concluded that the proposed project will not result in significant impacts to the environment. This EA and FNSI are prerequisites for the issuance of Division of Water Quality permits necessary for the project's construction. At your request, ESI has completed a jurisdictional delineation for the NE Brunswick Sewer Transmission upgrades. The project area is located in Brunswick County, North Carolina. The field evaluation was conducted in April 2012. Available mapping was reviewed prior to the field investigation. The United States Geological Survey (USGS) 7.5-minute topographic quadrangles (Winnabow, NC, Leland, NC, Wilmington, NC, and Castle Hayne, NC) depicts three surface water features [SMA, SMB/SMC, and Sturgeon Creek (SMF)] within the project area. Two additional surface water features (SMD and SME) were identified during the field evaluation. A stormwater pond was identified in the southeastern portion of the project area and is crossed by the project area was determined to be non - jurisdictional (Figure 3E). Sturgeon Creek is likely to be considered a navigable water by the U.S. Army Corps of Engineers (USACE) and regulated under Section 10 of the Rivers and Harbors Act. Crossings of Section 10 Waters require the issuance of a permit from the USACE prior to commencing any project construction activities. The unnamed tributaries to Sturgeon Creek are not potentially navigable waters and therefore will not be subject to Section 10 regulations. The project area is mapped as Baymeade fine sand, 1-6% slopes (BaB), Baymeade and Marvyn soils, 6-12% slopes (BDC), Blanton fine sand, 0-5% slopes (BnB), Chowan silt loam (CH), Forest loamy fine sand (Fo), Leon fine sand (Lo), Mandarin fine sand (Ma), and Muckalee loam (Mk) based on the Soil Survey of Brunswick County, North Carolina. Chowan silt loam, Leon fine sand, and Muckalee loam are hydric soil mapping units. Baymeade fine sand, Baymeade and Marvyn soils, Blanton fine sand, Foreston loamy fine sand, and Mandarin fine sand are non- hydric soil mapping units that may contain inclusions of hydric soils. These wetlands are classified as Headwater Forest (MA, MB, and ME/MF), Non -tidal Freshwater Marsh (MC, MG), and salt/brackish marsh (MD/MH) using the N.C. Wetland Assessment Method (NC WAM). The salt/brackish marsh wetlands are tidal wetlands are regulated by the N.C. Division of Coastal Management (NCDCM) under CAMA. The headwater forest wetlands include soils saturated within 12 inches of the surface and interspersed areas with evidence of inundation. Soils are characteristically hydric (Munsell Color: IOYR 2/1). Vegetation is hydrophytic and includes red maple (Acer rubrum), laurel oak (Quercus laurifolia), green ash (Fraxinus pennsylvanica), Virginia willow (Itea virginica), Southern arrowwood (Viburnum dentatum), netted chainfern (Woodwardia areolata), and lizard's tail (Saururus cernuus). The non -tidal freshwater marsh wetlands include soils saturated within 12 inches of the surface and areas with evidence of inundation. Soils are characteristically hydric (Munsell Color: IOYR 511). Vegetation is hydrophytic and includes cattail (Typha latifolia), soft rush (Juncus effusus), and alligator weed (Alternanthera philoxeroides). The salt/brackish marsh wetlands include soils saturated at the surface and evidence of frequent inundation associated with tidal fluctuation and a distinct hydrogen sulfide odor. Soils are characteristically hydric (Munsell Color: IOYR 2/1). Vegetation is hydrophytic and includes cattail (Typha angustifolia) and saw grass (Cladium jamaicense). Upland areas within the project area include roadside shoulders that are maintained on a frequent basis and forested slopes that are generally defined based on the absence of jurisdictional hydrology and hydric soils. Vegetation within these upland areas consists of sweet gum (Liquidambar styraciva), water oak (Quercus nigra), loblolly pine (Pinus taeda), and wax myrtle (Morelia cerifera). No evidence of jurisdictional wetland hydrology was observed within the upper 12 inches of the soil surface. Soils are non-hydric in nature (Munsell color 10YR 4/4). Unavoidable impacts to jurisdictional areas will require Section 404 and Section 401 permitting. Impacts may be permitted through either the Nationwide Permit (NWP) or Individual Permit process by the USACE, depending on the amount of impacts. Compensatory mitigation may be required for permitted wetland and stream impacts. Crossings of navigable waters will require prior approval from the USACE. Due to the presence of coastal wetlands at the Sturgeon Creek crossing, a CAMA permit will be required to authorize the proposed crossing in this location. The proposed crossing will likely be permitting under a CAMA General Permit. Utility lines: This NWP authorizes the construction, maintenance, or repair of utility lines, including outfall and intake structures, and the associated excavation, backfill, or bedding for the utility lines, in all waters of the United States, provided there is no change in pre - construction contours. A "utility line" is defined as any pipe or pipeline for the transportation of any gaseous, liquid, liquescent, or slurry substance, for any purpose, and any cable, line, or wire for the transmission for any purpose of electrical energy, telephone, and telegraph messages, and radio and television communication. The term "utility line" does not include activities that drain a water of the United States, such as drainage tile or french drains, but it does apply to pipes conveying drainage from another area. Material resulting from trench excavation may be temporarily sidecast into waters of the United States for no more than three months, provided the material is not placed in such a manner that it is dispersed by currents or other forces. The district engineer may extend the period of temporary side casting for no more than a total of 180 days, where appropriate. In wetlands, the top 6 to 12 inches of the trench should normally be backfilled with topsoil from the trench.
