Dear Ms. Coates,
I am writing to object to the application for Permit noted above and on the attached form, with the request that any
pier, stationary dock and floating dock constructions, if approved, all meet the CAMA square foot and set back
requirements and I do not waive any CAMA requirements.
In addition I noted to you in earlier correspondence the agreement dated October 17, 2011, between Todd Surratt
and me, recorded in Book 3207, page 0864, Brunswick County, NC Register of Deeds regarding the conservation
easement over the western one-half of said lot 13 and "no pier, or other structure or facility" shall be built on that
side of the lot.
It appears that the earlier proposed stationary docks were for the size of 1 Ox16 feet. The map I received for this
application dated 12/6/12 shows an increased size to 12x20 feet for the first time. I believe that this size combined
with the floating dock size of 12x16 may exceed the CAMA limit for a general permit. I was surprised at the
increase in size as all earlier maps submitted to me by Tommy Perry were for a smaller stationary dock. In my desire
to keep this area as natural as possible, I hope the size will be reduced.
Thanks for your consideration. I am enclosing also the notification /waiver form with my comments.
I know Mr. Surratt is anxious to build the pier and docks and I do not wish to slow up that process as building in the
colder months will cause less damage to the habitat, I think. However, I do want the guidelines and requirements to
be followed.

Street Closing Order
RESOLUTION
ORDERING THE CLOSING OF THAT
PORTION OF WEST PELICAN DRIVE
BETWEEN PARCELS 2340B00101 AND 2340B006
WHEREAS, on the 9's day of October 2012, the Town Council of the Town of Oak Island
directed the Town Clerk to publish the Resolution of Intent of the Town Council to consider closing that
portion of West Pelican Drive between Parcels 2340B00101 and 234OB006 more specifically described
as "Beginning at a point on the South right of way of West Dolphin Drive, said point being South 87
degrees 30 minutes Fast 90.06 feet from the Southeastern intersection point of 25"' Place West and West
Pelican Drive. From said beginning point thence North 02 degrees 30 minutes East 60.00 feet to a point,
thence South 87 degrees 30 minutes East 50.00 feet to a point, thence South 02 degrees 30 minutes West
60.00 feet to a point, thence North 87 degrees 30 minutes West 50.00 feet to the point of beginning. The
described parcel contains 3000.00 square feet and is a portion of West Pelican Drive between Lot 13
Block 76 and Lot 13 Block 87 A Map Book 2 %= Page 204;" said advertisement to be placed
in The State Port Pilot newspaper once each week for four successive weeks, such resolution advising
the public that a meeting would be conducted in the Oak Island Town Hall on November 13, 2012; and
WHEREAS, the Town of Oak Island Town Council on the 9* day of October 2012, ordered the
Town Clerk to notify all persons owning property abutting that particular portion of West Pelican Drive,
as shown on the county tax records, by registered or certified mail, enclosing with such notification a
copy of the Resolution of Intent; and
WHEREAS, the Town Clerk has advised the Town Council that she sent a letter to each of the
abutting property owners advising them of the day, time and place of the meeting, enclosing a copy of the
Resolution of Intent, and advising the abutting property owners that the question as to closing that portion
of West Pelican Drive described herein above would be acted upon, said letters having been sent by
registered or certified mail; and
WHEREAS, the Town Clerk has advised the Town Council that she further sent notification to
all property owners on West Pelican Drive between SE 23`d Place West and 25t° Place West; and
WHEREAS, adequate notices were posted on the applicable street as required by G.S. 160A-
299: and
WHEREAS, the owner of Lots 15 and 14, Block 87A, abutting Lot 13, Block 87A ,appeared in objection
to the street closing and presented a quiet Title Agreement, dated October 17, 2011, recorded in Book 3207, page
0864, Brunswick County. NC. Register of Deeds.
WHEREAS, after full and complete consideration of the matter and after having granted full and
complete opportunity for all interested persons to appear and register any objections that they might have
with respect to the closing of said street in the public hearing held on November 13, 2012; and
WHEREAS, it now appears to the satisfaction of the Town Council that the closing of said street
