This letter confirms that on March 5, 2014 an unauthorized marine vessel, creating a formalized slip, was observed at
your docking facility, which is located adjacent to Whiskey Creek at 4206 Purviance Court in Wilmington, New
Hanover County, North Carolina. On February 5, 2013 General Permit No. 61529D was issued to you for
construction of a fixed access pier and platform. This permit did not authorize any formalized boat slips due to
insufficient water depths at low tide at this location within Whiskey Creek. Please be advised docking at this fixed
platform creates a formalized slip which violates the conditions of General Permit No. 61529D.
The relevant statutes and regulations are available from this office, and I am willing to assist you in complying with
the requirements of these laws. Please contact me at (910) 796-7425 in order to ensure that the docking facility is in
compliance with the Coastal Area Management Act, the Coastal Resource Commission's rules, and the local
jurisdiction's Land Use Plan. Thank you for your time and understanding in resolving this important matter.
