Dooley, widow, and being purchased by Kimberly M. Moses and husband, Raymond E. Moses, Jr. Dear Ms. Wilson, The undersigned authorized representative of New River Plantation Community Services Association, Inc. (hereinafter, the "HOA") affirms the following regarding subject property and individuals: ■ The real property known as Lot 40, New River Plantation, Section II, having a common address of 800 Willbrook Circle, Sneads Ferry, NC 28460 and Onslow County Tax Parcel #: 771D-157, presently owned by Ms. Arlene G. Dooley, widow, has a private dock located upon it which encroaches somewhat into the marsh and/or right of way area upon adjacent common area presently owned by the HOA. ■ While the dock currently existing on said property is in need of repair and improvement, the extent of repairs necessary does NOT presently exceed 50% of the value of the structure. ■ The HOA has no objection to either the present owner, Ms. Arlene G. Dooley, or the prospective purchasers, Kimberly M. Moses and Raymond E. Moses, Jr., or any of their heirs, successors and/or assigns utilizing the boat dock for its intended purposes or making necessary repairs and/or improvements to the said boat dock at no expense to the HOA. ■ The HOA agrees that for so long as no greater than 50% of the said dock is destroyed, the dock may remain in its present location and utilized for its intended purposes as a dock without being relocated. ■ The HOA recognizes and agrees that this document may be and is intended to be used to obtain boat dock repair approval in compliance with Coastal Area Management Act (CAMA) guidelines and requirements.
