We object to both proposals and do not wish to waive the 15 foot setback requirement.
1. General Discussion
On 9/12./14 1 received a phone call on proposed dredging to support a pier at 8112 Bald Eagle Lane. Fifteen
minutes later, i received a registered letter on a proposed pier at 8112 Bald Eagle Lane. Both pertained to the lot
owned by me and my wife at 8116 Bald Eagle Lane.
To gain more information about the proposed changes, I called a few contacts at Porter's Neck. From these
calls, several question arose as to the scope of the project. Was the scope just my neighbor's pier and some
dredging? or, was it a larger scope of work dealing with three lots (8104, 8108 and 8112), three piers, and
dredging fairly close to shore and extending through at least five lots, and who was involved? Did this include
Coastal Management; an owner of one lot or three and the Corps of Engineers?
Of course, the comments received were all just for my information, but they indicated a larger scope than I was
originally made aware of .......... and included a proposal for zoning changes from single-family dwellings to
condominiums. So i went to the NCDENR Division of Coastal Management website to educate myself.
Eventually. I talked to Robb Mairs who assured me that the proper reviews would be completed. I mentioned
to him the question of a larger scope. He stated that the dredging was to be classified as "periodic maintenance"
and that the footprir:t of the pier system would be verified to meet existing requirements. His organization has a
lot, to do: verification of compliance with local land/use planning and zoning requirements and local development
regulations as wel' as interaction with Federal and other state organization, verification of ownership of adjacent
properties, deeds ('including "submerged land rights"), etc.
Zoning information lists the following: "The R 20S Residential District is established as a district in which the
principal use of the land is for low density single-family residential purposes. The regulations of this district are to
Permit development compatible with the preservation of its rural character and providing limited growth. It is
designed to accommodate residential opportunities for those who desire exurban, low -density lifestyle and are
willing to assume the costs of providing many of their own services and amenities while maximizing the protection
of resources and the conservation, of open space."
Il. Dredging
On 9/12/14, 1 asked the dredging contractor to send me the required form for my response. but said that my
initial feeling was that I would object due to:

I believe that we OWN the land involved via "submerged land rights" per our deed.
Discussion with the dredging contractor (Clements) was that this was for the developer of three lots south of
ours...,..... for larger boats.. ....... .and increased traffic. He stated that there was an existing channel to be
deepened and widened and that this channel was circa 1960's and that you could see the channel on Google
Earth. The contractor then asked if I would object to the dredging starting at the lot south of ours (8112 Bald
Eagle Lane)- I said that I would probably not object as THAT scope would not impact our lot.

plus a floating dock.
- Pier, length not listed. but total length of pier and fixed platform is 65 feet.
- the 20 foot by 2C foot gazebo is actually a 14 foot by 20 foot gazebo covered area (per the provided
diagram) with an additional 8 root by 20 foot "open area'; yielding a platform
of 22 feet by 20 feet
- and a 8 foot by 20 foot floating dock.
I think this is rather significant construction for an area for which "the principal use of the land is for low density
single-family residential purposes....." (per earlier zoning statement), At a height of about 17 feet above the
water, the complex will be visible from the top of the bank and from houses nearby. This seems to be less suite(
to those who desire an "exurban low -density lifestyle..... or conservation of open space". Also as stated per CAM)
Para i 13A-102 (a), (b) (1) - (4) conceming the public's opportunity to enjoy the physical, esthetic (water view),
cultural and recreational qualities of the natural shorelines. The pier complex does seen more suited to function
as a marina for 'large boats".
As it is designed. the pier complex cover over 60% of the available water frontage length (excluding riparian
access).
In general, it is large and obstructs waterfront viewing and it has the potential to be a noisy area. (I believe suet
a structure was proposed at one time as a neighborhood access area and was determined to not be in the best
interests of the neighborhood nor the immediate neighbors' lifestyle.)
iV. Summary
We abject to these two proposals as follows:
fi Dredging
- due to the potential for subsidence at the beach area
- the potential to impact cur "submerged land rights". If our "SLR's" are challenged, we need to know
the basis, chapter and verse.
The pier complex
- a large structure which inhibits views
- a stated purpose for larger boats ........ also the potential for more traffic
- And without the dredging, is such a large pier really needed?
We do not raise these objections capriciously as we have approved without reservations two previous request
for a pier extension at 8120 Bald Eagle Lane and a sea wall at 8112 Bald Eagle bane.
Nor do we do this maliciously, but because we wish to guard against even a gradual loss of the esthetic value
of our property.
Additionally, we ask for incorporation of the required reviews if the total scope is larger than was shown to us
in the initial waiver

Based on site visits by staff with our office on August 26, 2014 and October 1, 2014, and review
