Dear Mr. Knierim:
Please consider this letter a 90-day authorization for Meritech, LLC to go upon State lands
allocated to the Department Administration for the purpose of disposition of no more than 400 cubic
yards of dredge spoil material in the area as shown on the attached map and incorporated herein.
The project will be performed via mechanical dredging (bucket to barge) and will adhere to all
NCDCM/CAMA policies. By acceptance of this right of entry, evidenced by the performance of work
on the property, Meritech, LLC indemnifies and holds harmless the State of North Carolina for injury,
loss or damage arising out of the actions of Meritech, LLC its agents or contractors performing work
on the premises.
It is our understanding that this right of entry has been requested in the interest of time.
This right of entry is granted subject to all necessary Federal, State and local permits or approvals
required for the proposed project. The State shall also have the right to immediately terminate this
right of entry without prior written approval in the event Meritech, LLC violates the terms of this right
of entry and Meritech, LLC shall restore the property to its original condition.
