Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Mrs. Randolph,
Ironically, an hour after our telephone conversation today, our office received a letter and a copy of the survey you
referenced. I discussed your concerns and along with this survey with my supervisor, Mr. Roy Brownlow. It was
determined to be sufficient to demonstrate that the existing bulkhead does not encroach onto your property. The
applicant can simply locate and mark the survey control points (i.e. EIP) prior to construction in order to ensure that the
bulkhead extension does not encroach onto your property. If you have any further questions, please do not hesitate to

Mr. Brad Connell/DCM,
With regards to the wingback extension notice we received from Bobby Cahoon Construction, Inc on
December 15th, 2019, please note that this email serves as a written notice informing the DCM that we
currently object to the proposed work (ie Cahoon's Description of work (please refer attachments). The basis
for this objection is the amount of uncertainty involved in the proposed work. On several occasions, Mr. Eric
Loken has relayed to us (my husband and myself) of his own uncertainty of where his property line ends and
of his uncertainty of whether his existing sea wall is within the confines of his own property. The Lokens are
not the original owners of their home or the sea wall between our properties. Due to this great uncertainty, it
is paramount that Mr. Eric Loken takes responsibility to have his property professionally surveyed to ensure no
current encroachment exist or may result from this proposed work.
We object to the proposed work by Mr. Eric Loken until the following conditions are satisfied:
1) Mr. Eric Loken has a property survey completed clearly identifying the corners and the boundary line of his
property adjacent to our property, thus ensuring his existing seawall is not encroaching on our property and
none would occur by the proposed work. A copy of the completed registered land surveyor's drawing must be
supplied to us bearing the boundary and end points. The survey must maintain the highest level of accuracy as
the properties are waterfront properties on the lower Neuse River.
2) A clear, detailed description is provided of the proposed work. The current description of work is vague and
ambiguous. Questions such as:
1) Will any work be done to the existing sea wall of which the proposed extension applies?
2) Where exactly does the proposed wall extension begin and end?
3) Is the proposed final product a 30' wall (removing old wall & installing new vinyl wall) or does the proposed
plan involve adding 30' to the existing wall (which would receive strong objection and motivate legal action to
contest). Such a structure would leave our property (both land and home) at greater risk to potential erosion
overtime as a result of the potential hydrodynamic energy produced off of such vertical hard structure
erosion control mechanisms, harming our property over time. End toe scouring off of the Loken's existing
seawall has shown the negative effects of utilizing hard structure erosion control mechanisms for both of our
properties. In addition, geographically descriptive wording should be used to describe the proposed work
location (ie 'left side' is not satisfactory).
*Notice to Bobby Cahoon Construction, Inc. (ie equipment or persons) should remain only on Mr. Eric
Loken's property (which would be determined by the requested survey) during the proposed construction

thus ensuring no damage is done to structures or utilities on our property. We appreciate your
understanding.

Also enclosed is a copy of the letter sent, along with a survey map, to Mr. & Mrs. Randolph.
