Our objections to the boat lift proposed for construction in the navigable
waters adjacent to our property located at 52 N. Ridge, Surf City, NC
28445, include the following:
1. If applicants' proposed boat lift were to be authorized, it would
further reduce the size and width of an already narrow canal,
whose use and navigability has already been impaired by their
current dock, which extends into the canal in violation of the
applicable Sandy Ridge Subdivision Restrictive Covenants (see
objection 4 below).
2. Unlike all of the other boat lifts of which we are aware, whether
on Topsail Island or elsewhere, applicants are proposing
construction and maintenance of a boat lift not in front of, behind,
or immediately adjacent to the Sandy Ridge Subdivision lot on
which their home is situated, Lot 53, but to the side, and directly
in front of our home on Lot 52, thereby substantially impairing not
only our view of the adjacent Intracoastal Waterway, but the
market value of our property.
3. Although applicants have a "General Warranty Deed" which
purports to convey title to not only Lot 53 of the Sandy Ridge
Subdivision, on which is located their home at 53 N. Ridge, Surf
City, NC, but also certain tidelands adjacent to Lot 53 i.e., what the
deed identifies as "Tract II," they do not have valid title to or
ownership of "Tract II." There has not been an unbroken chain of
conveyance and ownership of said tidelands from the State of
North Carolina, which in fact continues to own them, including
restrictive covenants of Sandy Ridge Subdivision, which provides,
inter alia, that "[n]o dock or boathouse or walkway or pier shall be
constructed onto or over the waters of the canal adjoining the said
property...." The provisions of Article XXV apply to applicants'
property by virtue of Article I of said restrictive covenants.
Articles I and XXV are contained within the "Declaration of
Restrictive Covenants of Sandy Ridge Subdivision" that was duly
filed with, and recorded by, the Register of Deeds of Pender
County on April 10, 1992 and are currently located in Book 827,
page 108 in the office of said Register of Deeds. In accordance
with Article XXX, said restrictive covenants, "run with the land
and ... [are] binding on all parties and persons claiming under
them ...," including applicants, whose proposed boat lift would
further violate Article XXV and further reduce the size and width
of a narrow canal, whose use and navigability has already been
impaired by applicants' current dock.

ed your consultation on this one... I've got a plan in for a "sling" lift at 53 N. Ridge in Surf City, NC. The existing
)cated within a PNA, but the canal where the lift would be located has been historically dredged and actually hz
ve CAMA Major Permit (Sandy Ridge). Water depths next to the bank at the existing facility are minimal (+/- 1.`
tide) and this is where the lift would be installed, but again with an active major to dredge I don't know that w
ild be extremely concerned about the existing depths. I have attached a copy of their proposal as well as an ov
vhere the lift would go. Take a look and get back to me at your earliest convenience with your comments.

To Whom It May Concern:
On December 6, 2013, we received via registered mail an "Adjacent Riparian Property Owner
Notification Form" from the Antinori Marine Company in Sneads Ferry, sent on behalf of our
neighbors at 53 North Ridge, Surf City, Jack and Gail Brent.
We wish to formally notify your agency that we do have objections to the proposed boat lift
construction, and do not waive the 15' setback requirement.
It is our belief that, due to the unusual and peculiar location of the Brents' current dock and
walkway, the proposed structure would be detrimental to the enjoyment and value of our
property. The proposed boat lift would be directly across the canal from our dock, rather than
on the same side of the canal, as are all the others in the area. While we would have had no
objection to a boat lift on the property side, behind the Brents' house and to the side of ours, they
have no water access there.
In addition to the fact that our beautiful view of the marsh would be negatively impacted, a view
we consider our greatest property asset, the canal in this area is narrow and very shallow. We are
concerned that if a boat lift is built in the proposed location, near the end of the canal, navigation
by more than one boat would be difficult, if not impossible, and would restrict the use and
enjoyment of the dock on our property and eliminate the option of constructing a boat lift on our
property by its future owners.
Because we also wish to be good neighbors to the Brents, the decision to oppose their
construction plans has been a very difficult one for us. However, we feel that, to protect the
enjoyment and value of own property, we have no choice except to do so.

This letter is in response to your correspondence, which was received by the N.C.
Division of Coastal Management on June 9, 2014, regarding your concerns about the proposed
development by Mr. Jack Brent, at 53 N. Ridge, in Surf City, NC, adjacent to an unnamed canal
off Topsail Sound, in Surf City, Pender County, NC. The project consists of installing a 10' x
12' "sling" lift, along the western side of the canal, adjacent to your property. The project has
been determined to comply with the Rules of the Coastal Resources Commission (7H.1200) —
General Permit for Construction of Piers and Docking Facilities: In Estuarine and Public Trust
Waters and. Ocean Hazard Areas and as such, a permit has been issued to authorize the
development. I have enclosed a copy of the permit, as well as, the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the disputed permit decision. I have enclosed the applicable
forms and instructions that must be filed prior to that deadline. Please contact me at 910-796-
