Dear Ms. Snider:
On November 28, 2014, I received a Property Notification/Waiver form by certified mail, return
receipt requested with respect to the property referenced above. The form was accompanied by a
drawing dated 11-26-14. On December 1, 2014, my agent contacted Grice Construction as the
drawing did not accurately identify the property owners such that I could not make an informed
response. Mr. Brian Grice agreed that the drawing was inaccurate and he committed to fax a
revised drawing to me which I received on December 3, 2014. 1 understand from Ms. Shawn
Simpson of your office that you will consider my 10 day deadline to respond to the form to run
from the date on which I received an accurate drawing.
In addition, as instructed by Ms. Simpson, I am emailing all of the documents to you as well as
sending them by regular US mail.
If you have any questions or comments, please do not hesitate to call me.

I have no objection to this proposal provided that the completed project does not vary in any
manner from the revised drawing provided by Grice Construction dated December 2, 2014.
Specifically, (1) the setback encroachment does not exceed five (5) feet, (2) the setback
encroachment is for the float only, and (3) the boat lift is constructed on the ocean side of the
property.
I wish to waive the 15 foot setback requirement but only to the extent of five (5) feet as shown
on the revised drawing referenced above. My waiver shall not be construed in any manner as a
waiver of more than five (5) feet, i.e., no part of the proposed float shall be closer than ten (10)
feet from my area of riparian access.
