ADJACENT RIPARIAN PROPERTY OWNER NOTIFICATION/WAIVER FORM
Notes regarding form submitted by Property Owner Christopher T Lemmons, dated
1-28-2015; received by Adjacent Riparian Property Owner Glenn Harvey, by certified
mail on 2-13-2015, with objections noted and dated 2-15-2015.
The Lemmons' property in question is Lot 9 on Exhibits 1 and 2.
The Exhibit 1 drawing, with dimensions, that accompanied the form appears to be inadequate
in several respects. Lot 8 owner Harvey is concerned that the Lot 9 structure, as designed, may
interfere with plans for a similar structure for Lot 8. Note the following key points relative to
the submitted drawing and dimensions and relative to a later recorded survey:
• The survey used in the Exhibit 1 drawing —provided by property owner —was done in 1984,
is not the latest recorded survey of the Topsail Watch Subdivision, and it:
o does not indicate the location of the mean high water line
o does not indicate where the marsh ends and open water begins
o does not indicate the riparian area and how it may impact adjacent lot 8
• Exhibit 2 — not provided by the property owner - is a copy of the "resurvey" that was made
and recorded in 1992, showing the Marsh area for Lots 7 and 8, with an approximation of
the mean high water line for lot 9; Exhibit 3 is a copy of the "Note 2" referred to in Exhibit 2.
• Point "B" added to Exhibits 1 and 2 indicate the southeast end of lot 9, e.g., where the
diagram provided by Mr Lemmons indicates that the walkway would begin; with Point "C"
added where the walkway ends at the proposed dock; with the walkway length shown as
the distance from point B to point C, being 390 feet.
• Point "A" added to the more recent survey of Exhibit 2 is the approximate location of the
high water line, as determined in the 1992 resurvey for lots 7 and 8. The distance from the
point A (approximate mean high water line) to the point B (end of lot), where the property
owner's diagram indicates that the walkway will begin, is approximately 370 feet.
The above referenced dimensions and points, indicate either that the property owner plans to
start his walkway approximately 370' from the highland, or that he plans to construct a
walkway that is approximately 760 feet long, across approximately the marsh, past the small

NOTE 1: item 14 on the fifth page of the original Topsail 'patch restrictions
recorded in Book 683 at Page 65 purported to establish site line
limitations;
"14. Site Line Limitations. No fence, road, wall, hedge, or
shrub planting which obstructs the 100-foot road site lines shown on
the recorded plat shall be placed or permitted to remain on any corner
lot. No tree or shrub shall be permitted to remain within the site
line distance unless the foliage is maintained at a sufficient height
to prevent obstruction of such site lines".
This surveyor has reviewed both the recorded maps, (Map Book 21 Page
78, Pirate's Cove, and Map Book 22 Page 91, Topsail Watch) five times
each with a magnifying glass and no site lines exist on the recorded
plats.
In the opinion of this surveyor, Item 14 cannot be reproduced and is
invalid.
This surveyor did place site line restrictions with the same
regulations on Lots 8, 13, and 45 which are the only three corner lots
owned by the developer. The site lines on this map were dimensioned as
currently required under N.•C. Department of Transportation
requirements.
NOTE 2: Portions of Lots 1 thru 12 are marsh, (below the high water line).
This map contains complete surveys of Lots 7 and 8 which define the
marsh and highland. Persons using Lots 1 thru 12 are advised to seek

Dear Mr Lemmons,
First, I welcome you to Topsail Watch, both as owner of adjacent lot 8 and representative
of Murex, Inc. which is developing several other lots in the subdivision. Our family
believes that Topsail Watch is one of the coastal area's `best kept secrets' and no doubt
you came to the same conclusion.
We need to talk about your desire to have a walkway and dock constructed, as I clearly
wish to help you do that, as long as it does not interfere with a dock for Lot 8; however, I
was confused by the drawings that I received with the "adjacent property owner" form.
Given the timing of the mail, the President's Day holiday, bad weather, and the Division
Coastal Management's stated requirement to object "within ten days of receipt" of the
adjacent property owner form, I had no recourse, but to submit my objections directly and
promptly by certified mail (a copy of which is enclosed).
My bottom line concern is that to approve your plans, I must be certain that your
structure will not result in a future problem regarding an application for a similar
walkway and dock for Lot 8. It appears that the owner of Lot 7 has put a squeeze on that
side of Lot 8's riparian area, so I have to worry about your side of our area. The survey
that was used to sketch your plan is not the latest recorded survey for Topsail Watch (see
Bk27 p88 for the 1992 resurvey) and there appear to be some shortcomings with the
submitted diagram as noted in the enclosed material.
At this point in time, I don't know exactly what to suggest, to assure that Lot 8 also can
have a dock in the future. One possibility might be for me to apply for a permit
concurrently with yours, but the permit is good for only 4 months. Another is that, if I
were in a position to do so, I would suggest that we consider jointly constructing a
walkway and dock extending from our common property lines, to be shared between our
lots_ The problem with either thought is that it may he several vears before Lot R would

Brandon Grimes called me a couple weeks ago to tell me that he would be emailing me a
new drawing that evening. I emailed him a few days later reminding him that I never got
it and he said that he would mail me "another copy." I received the enclosed copy by
certified mail, but nothing except this one page with a sketch. If the DNR officials don't
need an adjacent property owner sign -off from me, that's fine; however, if they do need
it, I wanted to be sure that you know I did not receive a form with the sketch.
Frankly, I don't get much more information from this sketch than from the prior material,
relative to distances from other docks and the dimensions of our respective riparian areas.
For example, I don't think running the property lines straight out into the Intracoastal
water is quite the way the riparian areas are defined for our curved shoreline.
Nonetheless, as I told you, I have no intention of making it difficult for you to construct a
boat dock and my only concern is that any additional construction will not interfere with
future plans for constructing a dock for our adjacent Lot 8.
Let me know if you need anything further from me; otherwise, I will assume that you and
Jason Dail will assure that the future options for Lot 8 will not be compromised by the
plans and approval for your dock.

This letter is in response to your correspondence, which was received by the N.C.
Division of Coastal Management on February 20, 2015 and March 14, 2015, regarding your
concerns about the proposed development by Christopher Lemmons, at property located at 248
Topsail Watch Drive, in Surf City, NC, adjacent to the Topsail Sound. The project consists of
residential development on the subject property, including the construction of an access pier and
docking facility. The project has been determined to comply with the Rules of the Coastal
Resources Commission (7H.1200) — General Permit for Construction of Piers and Docking
Facilities, and as such, a permit has been issued to authorize the development. I have enclosed a
copy of the permit, as well as, the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the permit decision. I have enclosed the applicable forms
