This letter is in response to your correspondence, which was received by the N.C.
Division of Coastal Management on January 7, 2015, regarding your concerns about the
proposed development by Kings Villa HOA, at 202, 204, 206 and 208 Kings Landing Court,
Hampstead, NC, adjacent to the Atlantic Intracoastal Waterway and Topsail Sound. The project
consists of converting the existing floating docking system to a fixed elevated docking system,
along the eastern shoreline, adjacent to your property. The project has been determined to
comply with the Rules of the Coastal Resources Commission (711.200) — GENERAL PERMIT
FOR AUTHORIZING MINOR MODIFICATIONS AND REPAIR TO EXISTING
PIERIMOORING FACILITIES IN ESTUARINE AND PUBLIC TRUST WATERS AND OCEAN
HAZARD AREAS and as such, a permit has been issued to authorize the development. I have
enclosed a copy of the permit, as well as, the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Parry Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the disputed permit decision. I have enclosed the applicable
forms and instructions that must be filed prior to that deadline. Please contact me at 910-796-

Dear Mr. Clements:
On December 30, 2014, I signed a certified letter from you containing two attachments
regarding the above. I have reviewed the information you have provided and am
subsequently requesting clarification prior to signing the waiver form. My questions are as
follows:
1. What is the height of the new fixed dock?
2. How may feet does the current (and proposed) dock impede into the
required 15 foot riparian setback between my property line and that
of the boat lift/dock immediately adjacent to my property?
3. Are the fixed boatlifts themselves being raised, lowered or altered in any
way from their current status?
4. Are there any changes to the 10'x16' platform as it currently exists?
5. What is the size of the proposed connector (presently metal) and the 10'x16'
platform? The drawing is unclear.
The waiver form states that I must contact the Division of Coastal Management in writing
or by telephone. The listed telephone number has been disconnected. The correct number
is 796-7215. I have contacted the Division by telephone today. Copies of your
correspondence and this letter are being forwarded directly to them within the specified 10-

Thank you very much for your letter with attachments. The General Permit contained a
measured drawing of the proposed dock changes for the King's Villa H.O.A. The
information on the Permit was concise and quite helpful.
As a point of interest, I am enclosing a copy of the original drawing I received from Mr.
Clements which precipitated my questions regarding the new dock. I am also attaching a
copy of a response letter from Mr. Clements which I received following your discussion
with him.
I wish to convey my appreciation to you for your timely and thorough responses to my
concerns.

Dear neighbor,
As you may know, our current floating dock has taken another beating. We have talked to
Mark Clements with elements marine of Hampstead and he had suggested that we do a
fixed dock to access the boatlifts instead of the using a floating dock. We agree and have
asked him to remove the current floater and build a fixed dock to replace it. We are
hoping this will be the last time we have to deal with this problem and are requesting for
you to sign and return the CAMA form attached. Thank you for your help and
understanding in this matter.

Dear Mrs. Kuczmarski,
I spoke with Jayson Dale today [1/12/15] and he has explained to me that you were
needing more information on the proposed work requested at Kings Villa dock. I will
address each of your questions you submitted on 12/ 11 /2014.
1. The height of the new fixed dock will be set at 18 inches above mean high tide
or around 2 feet from the top of the existing dock.
2. The proposed new fixed dock to replace the existing floating dock will not
impede into the 15 foot setback. It is approximately 28' from the fixed deck to
the property line and 13' from the required 15' riparian corridor line.
3. The boatlifts will not be altered in any way from their current position.
4. No changes have been made to the existing docking facility at this time.
5. The gangway that is currently being used to access the floater will be removed
and a 6' wide by 1'0' long pier run will connect the two together.
I hope that this will help in resolving any issues you may be concerned with on this
request. I am sorry if I was unclear on my first response. If you would like to have an
