Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that I)prior to undertaking any activities authorized by this permit,the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief,certify that this project is consistent with the North Carolina Coastal Management Program.

Anthony Chaney declares, under the laws of the State of North Carolina,that this List is a true and
• correct statement of each and every party providing materials and/or labor as part of the Services herein
described.
5.PAYMENT.Payment shall be made to Anthony Chaney
In the amount of$10,600.00 upon completion of the services described in this Agreement Services
include a Non refundable Deposit fee for the amount of$5.300.00 which will need to be obtained before
work can proceed.
If any invoice is not paid when due, interest will be added to and payable on all overdue amounts at 1
percent per year,or the maximum percentage allowed under applicable laws,whichever is less. Walt
Webster shall pay all costs of collection, including without limitation, reasonable attorney fees.
In addition to any other right or remedy provided by law, if Walt Webster fails to pay for the Services
when due,Anthony Chaney has the option to treat such failure to pay as a material breach of this
Contract, and may cancel this Agreement and/or seek legal remedies.
6. FREE ACCESS TO WORKSITE.Walt Webster will allow free access to work areas for
workers and vehicles and will allow areas for storage of materials and debris. Driveways will be kept
clear for the movement of vehicles during work hours.
Anthony Chaney will make reasonable efforts to protect driveways, lawns,shrubs, and other vegetation.
Anthony Chaney also agrees to keep the Worksite clean and orderly and to remove all debris as needed
during the hours of work in order to maintain work conditions which do not cause health or safety
hazards.
7.DEFAULT.The occurence of any of the following shall constitute a material default under this
Contract.
a.The failure of Walt Webster to make a required payment when
due.
b.The insolvency of either party or if either party shall,either voluntarily or in
involuntarily,become a debtor of or seek protection under Title 11 of the United
States Bankruptcy Code.
c.A lawsuit is brought on any claim, seizure, lien or levy for labor performed or
materials used on or furnished to the project by either party,or there is a general
assignment for the benefit of creditors,application or sale for or by any creditor
or government agency brought against either party.
d.The failure of Walt Webster to make the building site available
or the failure of Anthony Chaney to deliver the Services in the time and
manner provided for in this Agreement.
8.REMEDIES. In addition to any and all other right a party may have available according to law of the
State of North Carolina, if a party defaults by failing to substantially perform any provision, term or
condition of this Contract(including without limitation the failure to make a monetary payment when due),
the other party may terminate the Contract by providing written notice to the defaulting party.This notice
shall describe the suffient detail the nature of the default The party receiving said notice shall have 30
days from the effective date of said notice to cure the default(s)or begin aubstantial completion if
completion cannot be made in 30 days. Unless waived by a party providing notice,the failure to cure or
begin curing the defaults)within such time period shall result in the automatic termination of this
Contract.
9.AMENDMENT.This Agreement may be modified or amended in writing, if the writing is signed by
each group.
Construction Contract
This Construction Contract(the"Contract"or"Agreement")is made as of 5/20/20 _

Anthony Chaney desires to provide Construction services to and
Walt Webster desires to obtain such services from
THEREFORE, in consideration of the mutual promises set forth below,the parties agree as follows:
1. DESCRIPTION OF SERVICES. Beginning on 6/1/20
Anthony Chaney will provide to Walt Webster the following services(collectiviey,the
"Services°):
Vinyl Seawall/Bulkhead and aooronriate backfill.
2.SCOPE OF WORK. Anthony Chaney will provide all services, materials and labor for the
construction of Seawall described above at the property of
located at 12 Shorey Ct. Oriental, NC 28571 .
_hereinafter referred to as ("Worksite").
This includes building and construction materials, necessary labor and site security,and all required
tools and machinery needed for completion of construction.
Anthony Chaney is only responsible for furnishing any building Improvements related to construction
of the structure, but not related to landscaping,grading,walkways, painting, sewer or water systems,
steps driveways, patios and aprons,ect unnless they are specifically agreed to in writing.
3.PLANS,SPECIFICATIONS AND CONSTRUCTION DOCUMENTS.
Anthony Chaney will make available to Walt Webster all plans, specifications, drawings,blueprints,
and simliar construction documents necessary for
Anthony Chaney to provide the Services described herein.Any such materials shall remain the
property of Anthony Chaney will promptly return ail such materials to Walt
Webster upon completion of the Services.
4. COMPLIANCE WITH LAWS. Anthony Chaney shall provide the Services in aworkmanlike manner,
and in compliance with all applicable federal, state and local laws and regulations, including, but not
limited to all provisions of the Fair Labor Standards Act,the Americans with Disabilities Act, and the
federal Family and Medical Leave act.
5.MATERIALS MID/OR LABOR PROVIDED. Anthony Chaney shall provide to
a List of each and every party furnishing materials and/or labor to Walt
Webster as a part of the Services,and the dollar amounts due or expected to be due with regards
to provision of the Services herein described.This List of materials and/or labor shall be attached to this
Agreement as Exhibit A.
