The right-of-way for said structure for the purpose of this consent is located as shown on EXHIBITS "A" and "B" attached hereto and made a part hereof and described as follows: North Topsail Bridge (Hwy 210). This consent is granted subject to the following conditions: 1. It is understood that this consent is effective only insofar as the property rights of the United States in the land to be occupied are concerned, and this consent does not relieve the Grantee from the necessity of obtaining grants from the owners of the fee and/or other interests therein. 2. The proposed construction authorized herein shall not be commenced until appropriate rights shall have been obtained by the Grantee from the record owners and encumbrancers of the fee title to the lands involved. 3. The exercise of the privileges hereby consented to shall be without cost or expense to the Department of the Army, under the general supervision and subject to the approval of the officer having immediate jurisdiction over the property, hereinafter referred to as "said officer" and subject to such regulations as may be prescribed by the District Commander, Wilmington District. 4. The Grantee shall supervise and maintain the said structure and cause it to be inspected at reasonable intervals, and shall immediately repair any damage found therein as a result of such inspection, or when requested by said officer to repair any defects. In the event such items are discovered on the premises, the Grantee shall immediately notify the District Commander, Wilmington District and the site and the material shall be protected by the Grantee from further disturbance until a professional examination of them can be made or until clearance to proceed is authorized by the District Commander. 15. Except as otherwise specifically provided, any reference herein to "Secretary", "District Engineer", "Installation Commander" or "said officer" shall include assignees, transferees and their duly authorized representatives. 16. SPECIAL CONDITIONS: a. Grantee must provide a "Schedule for Work" for construction activities to the Corps of Engineers Navigation Land use Coordinator {POC Justin Arnette (910) 251-41961. This schedule must be provided at least thirty (30) days prior to the commencement of this segment of your work. b. All work shall be conducted in strict accordance with applicable Department of the Army (DA), North Carolina Department of Environmental Quality (NCDEQ) and United States Coast Guard (USCG) requirements. c. The Grantee understands and agrees that, if future operations by the United Sates require the removal, relocation, or other alteration, of structure or work within the AIWW right-of-way herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Grantee will be required, upon due notice from the Corps of Engineers, to remove relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. d. All USCG requirements must be fulfilled including, but not limited to, installation of required signage and prior to commencement of work within the AIWW right-of-way. The Grantee shall be responsible for contacting the appropriate personnel at the US Coast Guard as well as the the Wilmington Marine Safety Office and obtaining any necessary permits or clearances. e. Grantee must install the pipeline, such that, no pipe shall be installed above -20 ft NGVD 1929 vertical datum within 90-ft channel width of the AIWW. f. Grantee must provide an "As -built" survey indicating the vertical and horizontal location of the pipeline alignment. Grantee shall provide both plan and cross -sectional views indicating following features: shoreline, channel limits, pipeline alignment, and signage location. The original general permit notification was submitted on February 2, 2017 but was returned due to delays in securing easements from two private property owners along the proposed route of the water main. These easements have been resolved by rerouting the water main alignment to avoid one of the two properties, and after a determination by legal counsel for the Onslow Water and Sewer Authority (ONWASA) that additional easements were not required for utility construction within the US Army Corps of Engineers Right -of -Way. Construction on the project will now take place within either USACE or NCDOT Right -of -Way, and approvals have been received from both entities for this work. The revised plans and original submittal documents are enclosed. This project includes the demolition of the existing 10-inch DIP water main that crosses the Intracoastal Waterway with the NC Highway 210 Bridge and the installation of a replacement water main.
