Division of Coastal Management on April 25, 2016, regarding your concerns about the proposed development by Frank and Julia Sherron, at property located at 406 Evelyn Lane, in Topsail Beach, NC. The project consists of the construction of a private docking facility at the address cited above. The project has been determined to comply with the Rules of the Coastal Resources Commission (07H .1200) — General Permit for construction of Piers: Docks: and boat houses in Estuarine and Public Trust Waters, and as such, a permit has been issued to authorize the development. I have enclosed a copy of the permit, as well as, the relevant statutes. If you wish to contest our decision to issue this permit, you may file a request for a Third Party Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to file for a Contested Case Hearing. The hearing request must be filed with the Director, Division of Coastal Management, in writing and must be received within twenty (20) days of the permit decision. Thank you for speaking with my husband on the phone about some of the details of the proposal for the pier at 406 Evelyn Lane. As I said in my earlier letter, I am glad to see an awareness of the riparian zone on the drawing. I have already sent you a copy of a survey, which CAMA has, showing data from the Corps of Engineers to establish the riparian line between 406 and 404 Evelyn Lane. I am not sure how that is measured on the ground by an applicant but I am glad to share our survey. How will you locate the riparian line? I now understand one of the factors in locating a pier, is the consideration of the " pier head line". While I assume CAMA will do the ultimate measuring and decision, on it I could see? From the drawing I see there is not a roof planned for the pier platform. We had mentioned concerns for unobtrusive lighting, for example " down lighting" but do not see any mention of this. Is there information on this? One of the distances shown on your drawing on the north side of our pier to the riparian zone on that side ( the side away from the Sherron's ) is incorrect - it should be 18.4 feet -not 15.4. I am enclosing a copy of a portion of the survey zoomed up to show the correct number. The survey is hard to read so it is not surprising it was picked up incorrectly. I note on the drawing you submitted, a repair of bulkhead. I understand there is a desire to connect to our bulkhead to prevent erosion. We are glad for this but would like some more information about it when you are ready to start construction so wecan be comfortable with what will be done. I have signed the enclosed form concerning use of the riparian zone, and I checked the box that I do not waive the zone. Subject to the need for clarity on these questions, and proper measurement and direction of the riparian lines the proposed construction appears to be within the waters of 406. This has with it a new drawing that we have not seen before. It purports to show the proposed construction within the riparian waters of 406 Evelyn Lane. On a preliminary review it appears the riparian line on our side of the property is shown commencing form a point other than the property corner. While it may be inadvertent, this may make a significant difference in location of improvements. I see the note that the line is to be confirmed by survey, but I want to be sure there is no waiver of the correct location of the riparian line from the property corner. This point is in the corner of the bulkhead on 406, not as shown as where the bulkhead for 404 joins the bulkhead for 406. 1 will mail a copy of the drawing showing what I am describing and a copy to the Sherron's as well.
