I have been contacted by Howard Ramsey about a determination by Robb Mairs that he does not have rir
its to enable construction of a residential pier. I believe Robb may have spoken to you about this. I have chec
recorded documents and found a declaration for the Hickory Knoll subdivision which I think resolves the quest
intent of the deeds to the lots as shown on the subdivision map to convey property all the way to high water li
rett's Creek. My client was not aware of this document and I expect Robb was also unaware of it. The subdivisii
:) also seems to indicate that the water side boundary is the water rather than a fixed line since the water side
indary is shown as a dashed line. I have attached a copy of the document for your information. Also attached is
y of the subdivision map. The Ramsey lot is lot 26. Please confer with DCM in Wilmington and let me know if th

THIS DECLARATION, made this the /3 day of July, 1977, by
the undersigned GEORGE T. CLARK, JR. , TRUSTEE for the General Investment
Company (see Declaration of Trust recorded in the New Hanover County Registry
in Book 836 at Page 182 and in Book 885 at Page 246) of New Hanover County,
North Carolina;
WITNESSETH:
WHEREAS: By deed recorded in the New Hanover County Registry
in Book 836 at Page 376, there was conveyed to the undersigned Trustee a tract
of real property in Federal Point Township, New Hanover County, North Carolina,
which said tract included all of the area shown upon and subdivided by that map
of Hickory Knoll recorded in said Registry in Map Book 9 at Page 17 (except
for those lots ir_ said subdivision which had theretofore been conveyed out by
the undersigned Trustee's predecessors in title). With respect to those lots
In said subdivision which front upon Everett's Creek (I. e. , Lots 21 through 31,
31A, and 31B), said map is ambiguous, in that the location of the rear lines
of said lots is not clearly defined.
NOW THEREFORE, in order to clearly define the location of the
Southern line of said lots, the undersigned Trustee hereby declares that the
Southern line of Lots 21 through 31. 31A, and 31B of said subdivision shall
be the Northern high water line of Everett's Creek, and that the Eastern and
Western lines of each of said lots shall be the Eastern and Western lines of the
same as shown uaon said man, extended Southwardly to the Northern hieh water

undersigned Trustee or by any of his successors in interest, of any of said
lots, in which conveyance such lot is described by reference to said map
