My paralegal and I worked through the chain of title and iewed the Declaration document you sent (1105/574) . Based on this review, I'm recommending to DCM that tl ier of Lot 26 is a riparian owner and that the demonstration of ownership pursuant to 15A NCAC 7J. 0204(b)(4) in satisfied by this deed and Declaration, down to the MHW of Everett's Creek. It's too bad that subsequent dE .ots 21-31 haven't (to my knowledge) included a reference to this Declaration, but that's my real estate attorne ;ing. And yes, the map 9/17 and it's lack of reference to MHW looks like the lots were not intended to be riparii I so the Declaration is needed to clarify (or change) the grantor's intent. inks for bringing this to your client's attention and to our attention. isty m: William A. I believe Robb may have spoken to you about this. I have chec recorded documents and found a declaration for the Hickory Knoll subdivision which I think resolves the quest intent of the deeds to the lots as shown on the subdivision map to convey property all the way to high water li rett's Creek. My client was not aware of this document and I expect Robb was also unaware of it. The subdivisii :) also seems to indicate that the water side boundary is the water rather than a fixed line since the water side indary is shown as a dashed line. I have attached a copy of the document for your information. Also attached is y of the subdivision map. The Ramsey lot is lot 26.
