Lots were soon parceled and sold. Lots #8 & #9 were purchased by the RLSimpkins family in the mid-50's. Lot #10 (i known as #1 OR) was eventually purchased by the Rooks family. Lots #9 and #1 OR border one another. From the time of purchase by the Simpkins and the Rooks family the had been no major topographical or elevation changes. There had been no erosion, standing water, drainac storm -water runoff issues. In 2015 lot #1 OR, the Rooks property, was transferred to a 2nd generation family member. Soon the residen building was torn down and hauled off; a new seawall was installed, a new boat launch was created, and re grading of the waterside of Lot #1 OR occurred. In concert and conjunction with the Lot #1 OR project mentioned above, and under the direction and supervi; of the 2nd generation Rooks family member, the waterside of Lot #9, the Simpkins property, was also enhai with a new seawall and re -graded. When the new boat slip was dredged on Lot #1 OR, the spoil, or dredge material, was required to be placed Lot #1 OR to drain and dry. The owner of Lot #1 OR chose not to remove the drained spoil from the site, but r chose to incorporate and re -grade the spoil into the waterside of Lot #1 OR. The addition of the extra spoil to Lot #1 OR raised the elevation above its long-term and natural elevation. A result, erosion, standing water, drainage and storm -water runoff has damaged and disrupted the natural drainage of Lot #9. The owner of Lot #9 is requesting to be made whole by the owner of Lot #1 OR. This correction would be at expense of Lot #1 OR's owner. Statement by Rodney L.
